(adj. to Howard's Branch of Mattituck Creek) Mattituck, NY BASIS OF APPLICATION: The applicants request a Special Exception pursuant to Article II1, Section280- 13B, subsection 14 of the Zoning Code, to operate a Bed and Breakfast within their existing single-family dwelling, accessory and incidental to their residential occupancy under the Building Department's Pre- Certificate of Occupancy -Z-14778, dated August 9, 1986. The proposed 4 bedrooms for lodging and serving of breakfast to the B & B casual, transient roomers was created through additions and alterations to the applicants' existing one family dwelling under Certificate of Occupancy No. Z-32613 dated 9/18/07. FINDINGS OF FACT AMENDED APPLICATION: At the Public Hearing held on 5/20/2010, the applicants agreed to reduce the number of proposed guest bedrooms, operate the Bed and Breakfast for seasonal use and to address additional concerns by neighbors for vehicular traffic and privacy. The applicants submitted to the Board of Appeals, a letter dated June 3, 2010 confirming theses modifications and arrangements, which are reflected in the description and conditions of the Special Permit granted herein. The Zoning Board of Appeals held a public hearing on this application on May 20, 2010 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, and upon review of the code requirements set forth pursuant to Article III, Section 280-13B(14) to establish a Bed and Breakfast use, the Board finds that the applicant complies with the requirements for the reasons noted below: 1. Anthony and Barbara Bonagura, the applicant(s) herein, are the owners of the property. It is improved with a two story frame home as shown on the survey by William Simmons, Ill, LSPC Land Surveyor, dated final survey July 30, 2007, the property fronts on Holbrook Lane, an unimproved road, for I01.90 feet, has 330 feet along the east property line, 84.45 feet on Mattituck Creek and 336.25 feet on the west property line. The owners/applicants will continue to occupy same as their principal residence while operating and managing the Bed and Breakfast. 2. The applicant's plans comply with the on-site parking requirements and provide for five parking spaces, two for the principal single-family use and one (1) for each of the Bed and Breakfast bedrooms. 3. The applicants complies with the requirements of a dwelling unit as defined in Section 280-4 of the Zoning Code. The Bed and Breakfast use, as applied for, is reasonable in relation to the District in which it is located, adjacent use districts, and nearby and adjacent residential uses. 5. The Special Exception is accessory to the principal use and will not prevent the orderly and reasonable use of adjacent properties. 6. The Bed and Breakfast will not prevent orderly and reasonable uses proposed or existing in adjacent use districts. 7. No evidence has been submitted to show that the safety, health, welfare, comfort, convenience or the order of the Town will be adversely affected by the use and its location. 8. This Accessory Use is authorized by the Zoning Code Section 280-13B(14) with Zoning Board of Appeals approval as noted herein, and with issuance of a Certificate of Occupancy from the Building Inspector as required by code before Bed and Breakfast is occupied. 9. No adverse conditions were found after considering items listed under Section 280-142 and 280-143 of the Zoning Code. 10. Submission of a Certificate of Compliance or similar document will be necessary for issuance by the Building Inspector certifying that the premises conforms to Chapter 280 of the Zoning Code for an Accessory Bed and Breakfast use. RESOLUTION OF THE BOARD: In considering all of the above factors, motion was offered by Member Goehringer, seconded by Member Schneider, and duly carried to GRANT~ the Special Exception permit for a Bed and Breakfast, to be used only in conjunction with the applicants-owners residence, as amended herein: SUBJECT TO THE FOLLOWING CONDITIONS: 1. Owners shall occupy this single-family dwelling as their principal residence. 2. Applicants agree to install flexible chain ladders in second floor guest bedrooms for emergency purposes 3. The owners of the subject property are required to maintain proper access of ingress and egress to their home during the existence of this Special Exception, over Holbrook Lane. 4. Applicants also agree to assist in filling pot-holes on Holbrook Lane. 5. Applicants agree to inform transient guests of special circumstances regarding Speed Limit of 5 MPH and yielding the right of way to on coming residents on Holbrook Lane. 6. Applicants agree to share in the cost of snow removal during the winter months with all the residents on Holbrook Lane. 7. Applicants agree to inform and enforce the rule of guests to remain on occupants property only, and not on any of the neighbors' property. 8. Applicants agree to provide a sign on their premises indicating no backing out onto Holbrook Lane. 9. Applicants agree to reduce the amount of transient guests to a maximum of three rooms during the Bed and Breakfast season. 10. Applicants agree to utilize this Special Exception during seasonal periods of each calendar year during the existence of this Permit, April 1 through November 30 of each year. 11. Applicants must provide a minimum of five on site parking spaces, two for the homeowners and three for transient guests. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued Before applying for a building vermit, the applicant or agent must submit to the Board of Appeals for approval and filing, two sets of the final floor plans showing the proposed three guest rooms~ and a site plan showing, 5 parking spaces and the location ofa oarkin~, sign conforming to the amended application and conditions granted herein. Failure to follow this procedure may result in the delay or denial of this Special Permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Number of Bedrooms - We reduced the occupancy from 4 rooms to 3 rooms. 3 rooms would be more productive and beneficial for us due to the f'mancial issues we are having. We have a lot of space in this large house and have ample parking. What we would like to do is appeal to the boating community and this would alleviate a lot of the road issues. Having folks arrive by boat would be unique. It was brought to our attention today that one neighbor; Lynn Tonneson had a change of heart. I was told that she is in full support of the 3 bedroom B&B. 2. Seasonal Use - We changed our months of operation to be from April Ist to Nov 30'I'. Therefore, we will not utilize the B & B in the winter months and will not be responsible for any snow removal or plowing. Such should be split between the 10 homes equally. 3. Road Maintenance - We will maintain the gravel road according to the following: 25% cost of the gravel to fill the potholes & 100 % cost of labor to fill potholes. All other road issues should be split evenly. Holbrook Lane does not have an association to collect monies to maintain the road. Since most of the other homeowners are concerned about the road/road maintenance I would like to know the following: Who will be responsible for collecting the money from each homeowner? Who will make sure that everyone pays their fair share so that the road is maintained properly? 4. Drivin~ Safet~ - Driving Directions Entering' Holbrook Lane - When on Miller Road go 5 mph & go cautiously down the hill and make a right turn onto Holbrook Lane. Remain at the 5 mph speed limit for the duration of Holbrook Lane. This is a private road and we do not want to destroy the road or disturb the neighbors. Esltlng Holbrook Lane - The speed limit is 5 mph on Holbrook Lane. Please proceed with extreme caution when you make the left turn onto Miller Road. There are many cars entering and exiting. Please Note: The friends and family of the other residents on Holbrook Lane need to follow these rules as well. 5. No Loitering - Guests are allowed to take a walk on the road Holbrook Lane but they must remain on the property at 900 Holbrook Lane. They will not wander onto any of the neighbors' homes because they are private properties. At 900 Holbrook Lane we have our own dock, beach and wrap-around porch for B&B use. Please Note: The friends and family of the other residents on Holbrook Lane need to follow these rules as well. As far as we know we meet all of the requirements needed to mn this B&B. In this economy we hope that we are able to be successful in this endeavor. We hope that we have answered all of the questions/concerns that the Board Members as well as the neighbors have indicated. FINDINGS OF FACT In considering this application, the Board has reviewed the cede requirements set forth pursuant to Article III, Section 280-31B(13) to establish an Accessory Apartment and finds that the applicant has failed to comply with the requirements for the reasons noted below: 1. The principle dwelling unit will occupy 1,423 square feet of livable floor area. Section 280-13B [c] of the Code requires a minimum of 1,600 square feel. This would in turn create a comparable amount of people, traffic and capacity as their small family of three renting 4-6 rooms to guests. The size of the house allows for many more people than a family of three, and we feel they should be given the opportunity to try to create a successful business endeavor with their property. We have been homeowners on Holbrook Lane since 2005, and know that Anthony & Barbara will work hard to maintain the peaceful, serene atmosphere that our neighborhood is known for. We have no doubt that their guests will enjoy a quiet and serene getaway when they visit the North Fork.
