SETTING OF THE NEXT PLANNING BOARD MEETING
Martin Sidor: Good evening, and welcome to the regularly-scheduled Southold Town
Planning Board Public Meeting. Our first order of business is to set Monday, June 14,
2010 at 6:00 p.m. at the Southold Town Hall, Main Road, Southold, as the time and
place for the next regular Planning Board Public Meeting.
William Cremers: So moved.

PUBLIC HEARINGS
6:00 p.m. - McCall Farm Winery - This site plan is proposing to alter an existing barn
totaling 2,480 sq. ft. into a winery within a Development Rights intact area of an 87.03-
acre parcel of Development Rights sold land. The proposed winery will have a lot
coverage of 0.065% in the A-C Zoning District. The property is located at 22600 Main
Road, Cutchogue. SCTM#1000-109-1-40

Russell McCall: I live at 10230 New Suffolk Avenue and this is my proposition. I'm
hoping to open a tasting reom in an existing building: not attempting to change the
exterior of the building but just to fix the inside up a little bit so that it conforms to the
Suffolk County Health Department regulations for bathrooms and so forth. What else
do you want to know?

CONSERVATION SUBDIVISIONS, STANDARD SUBDIVISIONS, RE-
SUBDIVISIONS (Lot Line Changes)
Amendment to Final Approval:
Zuckerber(~. Lloyd P. - This proposal is for an 80/60 clustered conservation
subdivision on 32.83 acres of land. Lot 1 equals 65,562 sq. ft., Lot 2 equals 77,694 sq.
ft., and Lot 3 equals 29.5416 acres and is proposed to be preserved through a Sale of
Development Rights to the Town of Southold. The property is located at 2350 Wells
Road, on the southwest corner of Wells Road and State Route 25 in Peconic.

Kenneth Edwards: Mr. Chairman, I will offer the following resolution:
WHEREAS, this proposal is for an 80/60 clustered conservation subdivision on 32.83
acres of land. Lot 1 equals 65,562 sq. ft., Lot 2 equals 77,694 sq. ft., and Lot 3 equals
29.5416 acres with 21,734 square feet of subdivision open space and is proposed to be
preserved through a Sale of Development Rights to the Town of Southold; and
WHEREAS, on April 12, 2010, the Southold Town Planning Board granted Final
Approval upon the maps prepared by Howard W. Young, Land Surveyor, dated April 2,
2009 and last revised on March 17, 2010, subject to the fulfillment of the following
conditions:
1. The filing of a plot plan with the Office of the Suffolk County Clerk showing the
dimensions, metes and bounds of the Drainage Area to be located within the
Subdivision Open Space on Lot #3 - "Conservation Area."
2. The filing of a Covenant and Restriction with the Office of the Suffolk County
Clerk which includes the following clauses:
The Drainage Area located on Lot #3 - "Conservation Area" - shall be
21,734 square feet which is the square footage of the subdivision open
space for this conservation subdivision.
b. The Drainage Area located on Lot #3 - "Conservation Area" - shall be
maintained in perpetuity by the landowner.
Maintenance shall include any and all re-grading, excavating, planting and
any other maintenance activities necessary to ensure proper functioning
of the Drainage Area.
c. All maintenance activities of the Drainage Area shall be approved by the
Southold Town Planning Board; and

WHEREAS, the Southold Town Planning Board has additional clauses to be included in
the above-referenced Covenant and Restriction to be filed and recorded with the Office
of the Suffolk County Clerk; be it therefore
RESOLVED, that the Southold Town Planning Board hereby amend the Final Approval
granted on April 12, 2010 upon the maps prepared by Howard W. Young, Land
Surveyor dated April 2, 2009 and last revised on March 17, 2010, by adding the
following conditions to be included as part of the Covenants & Restrictions to be filed
and recorded with the Office of the Suffolk County Clerk:
2e. A landscaped berm or a landscaped buffer, shall be placed and maintained
in perpetuity along the southern side of the common access driveway and the
northern boundary of Residential Lots 1 and 2 bordering the farm field so as to
minimize wind, dust, noise and possible run-off from the farm.
2f. The landscaped berm or landscaped buffer referenced in 2e. above shall be
planted only with vegetation choices identified in the approved Town of Southold
Planning Board Native/Natural Buffer Planting Specifications following Southold
Town Planning Board Approval.
2g. The existing trees along the eastern boundary of Residential Lots 1 and 2 on
Wells Road shall be maintained to be in compliance with Southold Town Code
§240-49 (I).
2h. When the existing trees referenced in 2g. above naturally expire, they shall
be replaced with street trees and/or landscaping only with vegetation choices
identified in the approved Town of Southold Planning Board Native/Natural
Buffer Planting Specifications following Southold Town Planning Board Approval;

Amendment to Conditional Final Approval:
Southview Preserve - This proposal is to subdivide a 14.54-acre parcel into three lots
where Lot 1 equals 44,735 s.f., Lot 2 equals 37,343 s.f. and Lot 3 equals 42,470 s.f.,
with the remaining 11.53 acres of the property to be preserved as open space. The
property is located on the s/s/o Main Bayview Road, approximately 900' e/o Cedar
Drive in Southold. SCTM#'s1000-87-5-21.4 and 21.7-21.11
Joseph Townsend: WHEREAS, this proposal is to subdivide a 14.54-acre parcel into
three lots where Lot 1 equals 44,735 s.f., Lot 2 equals 37,343 s.f. and Lot 3 equals
42,470 s.f., with the remaining 11.53 acres of the property to be preserved as open
space; and
WHEREAS, on March 29, 2010, the Southold Town Planning Board reviewed and
accepted the finalized Open Space Easement; and
WHEREAS, on April 12, 2010, the Southold Town Planning Board granted Conditional
Final Approval on the map prepared by Victor Bert, P.E., and Paul Racz, L.S., of
Nelson and Pope, dated January 18, 2006 and last revised on October 9, 2009, subject
to the following conditions:
1) Submission of twelve (12) paper copies and four (4) mylar copies of the Final
Plat
2) Five (5) copies of the Final Road and Drainage Plan
3) Submission of the filed and recorded Open Space Easement with the Suffolk
County Clerk's Office; and
WHEREAS, the Southold Town Planning Board will now include two additional
conditions to the previously issued resolution referenced above; and
WHEREAS, on April 26, 2010, the Southold Town Planning Board reviewed and
accepted the Performance Bond Estimate prepared by the Southold Town Engineer on
April 20, 2010; be it therefore
RESOLVED, that the Southold Town Planning Board hereby accept and approve the
Open Space Easement for the above-referenced proposed subdivision and recommend
same to the Southold Town Board;

Board hereby accept and approve the Performance Bond Estimate in the amount of
$92,750.00 as prepared by the Southold Town Engineer and recommend same to the

Joseph Townsend: and be it further RESOLVED, that the Southold Town Planning
Board hereby amend the Conditional Final Approval granted on April 12, 2010 on the
map prepared by Victor Bert, P.E. and Paul Racz, L.S. of Nelson & Pope dated January
18, 2006 and last revised on October 9, 2009, by adding the following conditions:
4) Submission of the Performance Bond in the amount of $92,750 as prepared by
the Southold Town Engineer on April 20, 2010 and required by Southold Town
Code {}240-32 Performance Bond:
a. Performance Bond Estimate. The amount of the undertaking, secured by
cash or certified check or other acceptable surety, will be based upon the
Town Engineering Office's estimate of the total cost of the required capital
improvements, including but not limited to road clearing, trail clearing,
landscaping and drainage, plus a reasonable estimate of anticipated
increased construction cost during the period of the life of the bond.
b. The Planning Board shaft pass a resolution either approving or modifying
the Performance Bond Estimate as recommended by the Superintendent
of Highways.
c. The Town Board shaft approve or disapprove the Performance Bond,
subject to the review and approval of the Town Attorney. If the
Performance Bond is approved, it shaft be filed with the Town Clerk, and
the Town Clerk shall notify the Planning Board, in writing, of the Town
Board's action.
d. The Chair of the Planning Board shaft not sign a final plat until notification
by the Town Clerk of the Town Board's approval of the Performance
Bond.
e. After construction of the public improvements covered by the Performance
Bond and prior to the release of the bond, the developer shaft prepare a
set of the approved drainage plans and street profiles amended to

indicate as-constructed information. The developer then may apply to the
Town Engineering Office and/or Superintendent of Highways for a final
inspection of the work. When the work has been completed to the satisfaction
of the Town Engineering Office and/or Superintendent of Highways, they
shall recommend to the Planning Board that the Performance Bond be
released. If the Planning Board is in agreement with the recommendation, the
Planning Board shall recommend to the Town Board that the Performance
Bond be released.
5) Submission of the Administration Fee in the amount of $5,565 made payable to
the Town of Southold as required by Southold Town Code §240-37
6) Submission of a Park and Playground Fee in the amount of $14,000 made
payable to the Town of Southold as required by Southold Town Code §240-
54(G).

Conditional Sketch Extensions:
Guada,qno, Patrick- This proposal is for a standard subdivision of a 10-acre parcel
into two lots where Lot 1 is 1.5 acres and Lot 2 is 8.5 acres, inclusive of a 2.5-acre
building envelope and 6 acres of subdivision open space. The property is located on
the n/s/o Orchard Street, approx. 1,008' w/o Platt Road in Orient. SCTM#1000-27-1-2
Donald Wilcenski: Mr. Chairman, I will offer the following resolution:
WHEREAS, this proposal is for a standard subdivision to subdivide a 10-acre pamel
into two lots where Lot 1 is 1.5 acres and Lot 2 is 8.5 acres, inclusive of a 2.5-acre
building envelope and 6 acres of subdivision open space; and
WHEREAS, on November 9, 2009, the Southold Town Planning Board granted
Conditional Sketch Approval on the sketch plan prepared by John C. Ehlers, L.S., dated
December 8, 2005 and last revised on February 16, 2009; and
WHEREAS, on April 12, 2010, the applicant submitted a request for a six (6) month
extension of Conditional Sketch Approval which will expire on May 9, 2010 due to
delays in receiving complete preliminary maps from the surveyor; and

WHEREAS, on April 26, 2010, the Southold Town Planning Board reviewed this
request for a six (6) month extension of Conditional Sketch Approval; be it therefore
RESOLVED, that the Southold Town Planning Board hereby grant a six (6) month
extension of Conditional Sketch Approval from May 9, 2010 to November 9, 2010.
