THIS INDENTURE, made the 3Wday of May, nineteen hundred and ninety-six

ARTHUR R. TRUCKENBRODT and DONNA L. TRUCKENBRODT, husband and wife, both
residing at no #Diedricks Road, Orient, New York
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the hems or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Orient, Town of Southold, County of Suffolk and State of
New York, being bounded and described as follows:
BEGINNING at a point at the northeasterly corner of the premises described herein said point
being the intersection of the northwesterly corner of the land now or formerly of Truckenbrodt
and the southerly side of the land now or formerly of Abbott and Swanson:
RUNNING THENCE along the land now or formerly of Truckenbrodt south 48 degrees 43
minutes west 105.81 feet to the land now or formerly of Brown:
RUNNING THENCE along said land now or formerly of Brown north 41 degrees 17 minutes
west 175.16 feet to the ordinary high water mark of the Long Island Sound;
RUNNING THENCE along the ordinary high water mark of the Long Island Sound north 67
degrees 12 minutes 50 seconds east 111.57 feet to the land now or formerly of Abbott and
Swanson;
RUNNING THENCE along the said land of Abbott and Swanson south 41 degrees 17 minutes
east 139.76 feet to the point or place of BEGINNING.
TOGETHER with a right of way 16.5 feet in width as set forth and defined in Liber 5606, page
158 and Liber 2642, page 438 from the subject premises to the Main Road for the purposes of
ingress and egress.

with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
