Southampton, NY 11968 RE: PHILIP STANTON 845 MAPLE LANE, SOUTHOLD SCTM#64-1-29 Dear Mr. Herrmann; The Board of Trustees reviewed the survey prepared by David L. Saskas last dated May 3, 2010 and determined the proposed alterations to the existing dwelling and construction of a swimming pool to be out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code. Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111 ) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 100' landward from the top of the bluff and/or wetlands jurisdictional boundary, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary best management practices are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. This determination is not a determination from any other agency. If you have any further questions, please do not hesitate to call. Southold~ SCTM No. 100064-1-29 Dear Mrs. Doberty: We ~resent Philip Stanton, who plans to undertake various improvements on the captioned property, including dwelling alterations and renovations and construction of a swimming pool, all as depicted on the site plan prepared by Saskas Surveying Company, P.C., last dat~l May 3, 2010, a copy of which is enclosed along with photographs of the site taken on May 25, 2010. As all proposed work and related construction activities will occur more than 100 feet from the tidal wetlands boundary associated with Town Creek, the proposed activities will occur beyond the jurisdiction of the Board of Trustees pursuant to §275-3(C)(5) of the Southold Town Code. · Please note that as depicted on the site plan, a project-limiting fence and staked haybales will be emplacod along the 100-foot setback to ensure that all construction activities do in fact remain outside of the Trustees jurisdiction. Therefore, would you kindly prepare a non-jurisdiction letter for the project that can be provided to the Building Department.
