TERRY, residing at 36205 Main Road, Orient, New York 11957 © 3 party of the first part, and . 0 RONALD E:LTON TERRY, residing at 35 Kimberly Circle, Brunswick, Maine 04011 party of the second part, WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, a thirty—three (33%) percent interest inand to ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, DIST lying and being iti-the at Orient, Town of Southold, Suffolk County, New York, bounded northerly by Main Road (NYS Route 25) , easterly by lands now or formerly of 1000 Spencer Terry, southerly by Little Bay and westerly by lands now or formerly of Harold Latham. Department of Environmental Conservation. 020.00 This conveyance of a thirty—three (33%) percent interest in the above—described parcel of real property, together with a certain conveyance made on December 15, 1995 from Lloyd E. Terry, party of the first part, to Ronald Elton Terry, BLOCKparty of the second part, constitutes ownership of the above-described premises as follows: Lloyd E. Terry owns a seventeen (17%) percent interest in said property and Ronald Elton Terry owns an eighty-three (83%) percent 03.00 interest in said property, as tenants in common without right of survivorship. BEING AND INTENDED TO BE the same premises devised to Lloyd E. Terry under LOT the Last will and Testament of Caroline M. Terry, dated pecember 4, 1956, admitted to probate in the Suffolk County Surrogate's C8urt, File 329 P 1958. 003.000 TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND .TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indentl re so requires.
