PROPERTY FACTS/DESCRIPTION: The applicant's property is located on the north side of Pine Tree Road in Cutchogue. The lot has 237.16 ft. of frontage along north side of Pine Tree Road and 150 ft. along the east side of Bay Avenue; the most northerly line is 160.67 feet in length, and the remaining easterly line is angled, with a distance of 147.97 feet. The property is shown on a Map of Nassau Farms as combined Lots 101 and 102 and consists of a total area of 28,339 sq. ft. BASIS OF APPLICATION: Building Department's May 1, 2002 Notice of Disapproval denying a permit to construct an addition and alterations to an existing principal building for the reason that the setback will be 33 feet instead of the code requirement of Section 100-244B of 40 feet from the front lot line at its closest point. FINDINGS OF FACT The Zoning Board of Appeals held a public headng on this application on September 19, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. AREA VARIANCE RELIEF REQUESTED: Applicants request a seven ft. vadance from the southeasterly comer of a proposed garage addition, leaving a 33+- ft. setback from the front lot line facing Pine Tree Road (at its closest point). REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, and personal inspections, the Board makes the following findings: 1. Applicants own a non-conforming 28,339 square foot parcel with two front yards in the R-40 zone. The parcel is improved with a one-story house with attached garage. The applicants have applied for an addition of a garage with a setback of 33 feet from the front yard line instead of the 40 feet requirad in an R-40 zone. Page 2 - October 3, 2002 Appl. Grant of the variance will not produce an undesirable change in the neighborhood or a detriment to nearby properties. The placement of the new garage will make the street safer as there will not be any backing out onto Pine Tree Road. 5. The benefit sought by the applicant cannot be achieved by some other means other than an area variance. The applicant is limited in their ability to add an addition due to the this non-conforming lot and having two front yards. 6. This difficulty is self-created as the applicant wanted to expand their house on a non- conforming lot. 7. The vadance is not substantial as the setback from the front line will be 33 feet instead of the required 40 feet. 8. The vadance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. No evidence has been submitted to suggest that this vadance will have an adverse impact on the physical or environmental conditions in the neighborhood. 9. Grant of this requested vadance is the minimum necessary for the applicants to enjoy an addition of a new garage in order to expand the living space of their home.
