TERMS AND CONDITIONS
The Permittee Trust U/W of R.C. Kopf F/B/O Kristen Powers, residing at 220 Park Avenue
Ext., Mattituck, New York as part of the consideration for the issuance of the Permit does
understand and prescribe to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Pennittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to thc inspection and approval of thc Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the fight of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstraction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be reqtfired
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, Apd121,2010 regarding the above matter:
WHEREAS, En-Consultants, Inc. on behalf of TRUST U/W OF R.C. KOPF F/BIO
KRISTEN POWERS applied to the Southold Town Trustees for a permit under the
provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the
Town of Southoid, application dated February 12, 2010, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Headng was held by the Town Trustees with respect to said
application on Apd121, 2010, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of TRUST U/W OF
R.C. KOPF F/BIO KRISTEN POWERS to replace existing +/-57' wood groin with +/-65'
Iow-profile, vinyl groin in more landward location by removing most seaward 33 feet of
existing groin; removing and replacing (in-place) most landward 24 feet of existing groin

Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

documentation submitted concerning this application, and,

Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed

people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
KRISTEN POWERS to relocate existing house to the north side of
existing location and place on piles, construct a roofed porch
on south side, a 12' X 38' deck and a deck and addition on north
side. Existing garage to be rebuilt and relocate existing
walkway. All with.condition that the septic system be shown on
survey.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

Dear Mrs. Doherty:
As discussed during the public hearing on the captioned project, please find enclosed (3) copies of a project
plan prepared by En-Cousultants, Inc., last dated April 30, 2010, which has been revised to show the complete
removal and replacement of the existing wood groin with a low-profile groin In a more landward location.
Specifically, the most seaward 33 feet of existing groin will be permanently removed; the most landward 24 feet
of existing groin will be removed and replaced (in-place) with a low-profile, vinyl groin; and the vinyl groin
will be extended approximately 41 feet landward. The resulting structure, as compared to the originally
proposed 82-foot partial wood/partial vinyl groin, will be a 65-foot low profile, vinyl groin. Please also note
that the adjacent steel groin would now also be removed completely.
Although I believe that this plan is consistent with our discussions, please let me know if you require anything
further before your approval can be issued. By copy of this letter and revised plans, I am similarly notifying the
other Involved agencies of the above described changes.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review
of the Town of Southold Town Code and the Local Waterfront Revitalization Program
(LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action is CONSISTENT with
the following Policy Standards and therefore is CONSISTENT with the LWRP.
This recommendation was based on the following.
Policy Standards
4.1
Minimize losses of human lite. and structures from flooding and erosion
hazards.
The following management measures to minimize losses of human life and structures
from flooding and erosion hazards are suggested:
Use hard structural erosion protection measures for control of erosion
only where:
The principal use is residential. The fetch and exposure of the
location warrant the use of a hardened control structure to slow and
trap the west-east migrating sand and re-nourish the beaches. Note
that field inspection indicates that the recent Nor'easter which
occurred over the weekend of March 13, 2010 has shifted sand that
once comprised the beach, northward under the residence. In
addition drainage patterns indicate that during wave actions and
high tide periods, water flows around the northern end of the groin
eroding sand back into thebay.
The proposed hard structural erosion protection measures are:
a. limited to the minimum scale necessary
b. based on sound engineering practices
Practical veqetative methods have been included in the proiect design
and implementation.
Due to the elevation of the grade (beach) and tidal exposure, the use
of vegetation within this area is not a practical erosion control
method.
It is strongly recommended that the groin field be reviewed in its entirety and not as
individual groins for a long-term solution to protecting the residential structures along
this dynamic shoreline.
Pursuant to Chapter 266, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

The project is consistent with Policy 4 because only a hard structural erosion protection measure such as the proposed landward
extension of the groin will adequately stabilize the eroding sandy, unvegetated, bay beach located immediately landward of the intertidal
zone. Pursuant to Policies 4. I(A), (B), and (C), respectively, the existing dwelling was already relocated landward more than 10 years
ago; it would not be possible to stabilize the beach immediately landward of the intertidal zone with vegetative plantings due to the fetch
at this location and the associated wave energy on the beach; and there are no elevated dune areas or other natural protective features
that can be enhanced other than the beach, whose elevation and width would be enhanced via the proposed groin extension.
Specifically, while the existing functional groin continues to stabilize the foreshore, it has effectively become too short on its landward
end to stabilize the beach now located entirely behind it. This is a consequence of the chronic erosion and ultimately the landward
migration of this stretch of shoreline. In response to that landward shoreline migration, the house was relocated and now the groin must
be effectively relocated landward as well.
