TERMS AND CONDITIONS The Permittee Mark & Barbara Madden, residing at 2785 Cedar Beach Road, Southold, New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. Box 1179 Southold, New York 11971-0959 Telephone (631) 765-1892 Fax (631) 765-6641 May 19, 2010 BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD Mr. & Mrs. Mark Madden 2785 Cedar Beach Road Southold, NY 11971 RE: MARK & BARBARA MADDEN 2600 CEDAR BEACH ROAD, SOUTHOLD SCTM# 89-2-1 Dear Mr. & Mrs. Madden: The Board of Town Trustees took the following action dudng its regular meeting held on Wednesday, May 19, 2010 regarding the above matter: WHEREAS, MARK & BARBARA MADDEN applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated April 20, 2010, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the dock, ramp and floats already exist, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on May 19, 2010, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of MARK & BARBARA MADDEN for the existing 3'x75' catwalk, replace the existing 3'x12' ramp with a 3'x20' ramp, and for the existing 5'x16' floating dock and 6'x24' floating dock, and as depicted on the site plan prepared by Mark & Barbara Madden, received on April 20, 2010, and stamped approved on May 19, 2010. The dock shall consist of the following components only: a) a ramp that is no larger than 12 feet in length by 3 feet in width; b) two floats, one of which shall be no greater than 16 feet in length by 5 feet in width, and the other of which shall be no greater than 24 feet in length and 6 feet in width. 'Notwithstanding the dimensions of said ramp and floats, in no ~vent shall.the distance between said edge of vegetation and the ~.~urthest point of any dock component be more than 32 feet. Annexed hereto as Schedule "B" is a diagram depicting the configuration of the dock showing the ocatlons of the ram~ and 1 ' floats. c) such piles and'hardware as may be required to secure the dock. 5. The "access to dock" shall be a wooden structure commonly known as a "catwalk" no wider than 3 feet and no longer than 75 feet, which shall be·constructed on piles Over the r ' p emlses. The dimensions of the dock and access to dock above shall not change, except that they may be in s~ze. In no event shall the distance from the edge furthest portion of the dock be greater than 32 7. The floats, ramp and catwalk shall be constructed in'~ good, workmanlike manner of CeA treated lumber left in its natural conditi6n. Said floats, ramp and catwalk shall remain unpainted with no roofs or covers thereon. Side railings, to the extent required by applicable building codes, may be.permitted, so long as constructed out of the same materials as set forth above, and so long as they remain unpainted. 8. The dock and access to dock, described above, shall be maintained by D~Q~ARANTS, their successors and assigns, at their sole cost and expense, and shall be maintained in good condition. 9. Nothing herein shall diminish whatever rights of use Robert Gazza, Diane Gazza, Raymond J. Akscin and Geraldine Akscin, their successors and assigns, as owners of lots on the "Map of Cedar Beach Park", may have by virtue premises as "Community Beach" on said but not limited to, the right to pass of the designation of the subdivision map, including by foot over, under and on any portion of the dock and aceess to dock. Nothing herein contained, however shall be deemed to grant to Robert Gazza, Diane Gazza, Raymond J. Akscin and Geraldine Aksein, their successors and assigns, the right to tie or moor boats at the dock. 10. There shall be no structures constructed or placed ~n~ r the p emlses other than as set forth herein. 11. Th~ aforementioned restrictive covenants shall be enforceable by: Robert Gazza, Diane Gazza, Raymond J. Akscin and Geraldine Akscin, their successors and assigns, by injunctive relief or by any other remedy in equity or at law. The DECLARANTs, their successors and assigns, shall have no liability for the acts of third parties arising out of the designation of the premises as "Community Beach" on the "Map of Cedar Beach Park". The failure of said Robert Gazza, Diane Gazza, Raymond J. Aksein and Geraldine Akscin, their successors and.assigns to insist upon strict performance of any of the terms, conditions and covenants herein or to enforce the same shall not be deemed a waiver of any rights or remedies that they may have and shall not · be deemed a waiver of any subsequent breach or default by said DECLARANTS, their successors and assigns. 12. SCTM#89-2-1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the below Policy Standards and therefore is iNCONSISTENT with the LWRP. The applicant HAS NOT demonstrated that the action fully meets the below policies. In addition the LWRP states "Piers, docking facilities, and catwalks must not result in an unnecessary interference with use of public trust lands. Alternatives to long piers or docks include use of dinghies to reach moored boats and mooring in nearby marina". The subject parcel already has access to public waters via an existing dock structure. It is unclear why the extension of the dock structure further into public waters is necessary. 6.3 Protect and restore tidal and freshwater wetlands. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The applicant has not demonstrated that the following dock standards pursuant to § 275-11. Construction and operation standards have been met (d) Review and approval of dock applications.
