AUTHORIZATION
Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
May 19, 2010, and in consideration of application fee in the sum of $250.Q0 paid by Mark & Barbara Madden
and subject to the Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees
authorizes and permits the following:
Wetland Permit for the existin~g 3'x75' catwalk, replace the existing 3'x12' ram
with a 3'x20' ramp, and for the eXis~g 5'x16' flOating doCk and 6'x24' floating dock,
and as depicted On the site plan prepared by Mark & Barbara Madden, received on
April 20, 2010, and stamped approved on May 19, 2010.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee Mark & Barbara Madden, residing at 2785 Cedar Beach Road, Southold, New
York as part of the consideration for the issuance of the Permit does understand and prescribe
to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Pennittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
That the said Board will be notified by the Permittee of the completion 0fthe work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Mr. & Mrs. Madden:
The Board of Town Trustees took the following action dudng its regular meeting held on
Wednesday, May 19, 2010 regarding the above matter:
WHEREAS, MARK & BARBARA MADDEN applied to the Southold Town Trustees for
a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland
Ordinance of the Town of Southold, application dated April 20, 2010, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: the dock, ramp and floats already
exist, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on May 19, 2010, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of MARK & BARBARA
MADDEN for the existing 3'x75' catwalk, replace the existing 3'x12' ramp with a 3'x20'
ramp, and for the existing 5'x16' floating dock and 6'x24' floating dock, and as depicted
on the site plan prepared by Mark & Barbara Madden, received on April 20, 2010, and
stamped approved on May 19, 2010.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per i.nspection. (See attached schedule.)

by 3 feet in width;
b) two floats, one of which shall be no greater than
16 feet in length by 5 feet in width, and the other of which shall
be no greater than 24 feet in length and 6 feet in width.
'Notwithstanding the dimensions of said ramp and floats, in no
~vent shall.the distance between said edge of vegetation and the

8. The dock and access to dock, described above, shall be

sole cost and expense, and shall be maintained in good condition.
9. Nothing herein shall diminish whatever rights of use

for the acts of third parties arising out of the designation of
the premises as "Community Beach" on the "Map of Cedar Beach
Park". The failure of said Robert Gazza, Diane Gazza, Raymond J.
Aksein and Geraldine Akscin, their successors and.assigns to
insist upon strict performance of any of the terms, conditions and
covenants herein or to enforce the same shall not be deemed a
waiver of any rights or remedies that they may have and shall not
· be deemed a waiver of any subsequent breach or default by said

County of Suffolk (Index No. 88-12912).

Amendment of Declaration of Covenants and Restrictions
A Declaration of Covenants and Restrictions made on the 1st day of August, 1989, by
Edward R. Deutsch, Declarants which restricted the use and enjoyment cfa certain
property known as "community beach" on the "Map of Cedar Beach Park" filed in the
office of the Clerk of the County of Suffolk on December 20, 1927 as map number 90,
which parcel is more particularly described upon Schedule "A" annexed hereto ( Herein
referred to as the "premises" ) and which said Covenants and Restrictions were recorded
at 8/21/89 in Liber 10914 page 368 in the office of the Clerk of Suffolk County; and
The owners of the premises and successors in title from Edward R. Deutsch and
Eileen E. Deutsch, being Mark Madden and Barbara Madden, his wife, residing at 2785
Cedar Beach Road, Southold, NY, 11971 who are bound by said Covenants and
Restrictions; and
Whereas the dock is shared by the owners of three parcels on a Southold Town
Planning Board approved" Subdivision Map of Cranberry Acres at Bayview" dated
September 28, 1987; and
Whereas the parties wish to amend two items in the Covenants and Restrictions,
namely the length of the ramp and the maximum allowable distance from the edge of the
marshgrass to the outer edge of the dock.; and
Whereas; the Covenants and Restrictions are enforceable by Robert Gaz?a, Diane
Ga77a, Raymond Jay Akscin and Stella Akscin, their successors and assigns, by
injunctive relief or by any other remedy in equity or at law. Said Covenants and
Restrictions may not be terminated, revoked or amended by the owner without the

1, 'lhere appears to be no maintenance agreement for tile 25 foot right of way. My
clients cannot obtain construction financing without an agreement as to who is responsible for
maintaining lhe ~ght of way.
2. 'llae existing dock was damaged in tile last storms and we would like to add a
p~ovision ill the contract that your client will repair the dock to its original condition print Io

3. We would also like to add a provision in the contract that in tire event that the
final survey reflects that the parcel is less than 5 acres, that the purchaser may cancel the
contract and upon cancellation, to have Ihe contract deposit money returned to fllem.
4. ~lhe Easement Agreement that you furnished to me is for Full Mill Realty Group and
relates to lot #3 and slip #1. We would need a separate easement agreement framing to my
clients specifically lot #1 and slip #2.
tn the Easement Agreernent in paragraph 1 (page 2), we would like to specify tile size
of the dock and in paragraph 5(a), add the words "as it presently exists" (see copies enclused).
I believe your client has already agreed to the terms of the revise rider concerning the
llealth Department approvals, a copy of which is enclosed.

THE ACTION IS LOCATED IN A NYSDEC CRITICAL ENVIRONMENTAL AREA AND
NYSDOS SIGNIFICANT FISH AND WILDLIFE HABITAT.
MARK & BARBARA MADDEN request a Wetland Permit for the existing 3'X 75'
catwalk, replace the existing 3'X 12' ramp with a 3'X 20' ramp, and for the existing 6'X
24' floating dock. Located: 2600 Cedar Beach Rd., Southold. SCTM#89-2-1
The proposed action has been reviewed to Chapter 268, Waterfront Consistency
Review of the Town of Southold Town Code and the Local Waterfront Revitalization
Program (LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action is INCONSISTENT
with the below Policy Standards and therefore is iNCONSISTENT with the LWRP.
The applicant HAS NOT demonstrated that the action fully meets the below
policies.
In addition the LWRP states "Piers, docking facilities, and catwalks must not result in
an unnecessary interference with use of public trust lands. Alternatives to long piers or
docks include use of dinghies to reach moored boats and mooring in nearby marina".
The subject parcel already has access to public waters via an existing dock
structure. It is unclear why the extension of the dock structure further into public
waters is necessary.
6.3
Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the Southold Town
Board of Trustees laws and regulations for all Andros Patent and other
lands under their jurisdiction
Comply with Trustee regulations and recommendations as set forth
in Trustee permit conditions.
The applicant has not demonstrated that the following dock standards
pursuant to § 275-11. Construction and operation standards have been met
(d) Review and approval of dock applications. Before issuing a permit for a
dock structure, the Trustees shall consider whether the dock will have any of the
following harmful effects:
[2] Whether the dock will unduly interfere with the public use of waterways for
swimming, boating, fishing, shellfishing, waterskiing and other water-dependant
activities;
[3] Whether the dock will unduly interfere with transit by the public along the
public beaches or foreshore;
[5] Whether the dock will cause degradation of surface water quality and
natural resources;
[6] Whether the dock will cause habitat fragmentation and loss of significant
coastal fish and wildlife habitats;
The proposed action is located within a New York State Critical
Environmental Area. At the discretion of the Board of Trustees, any
operations proposed in critical environmental areas (§ 275-2) may be
subject to more stringent requirements than detailed in this section. Such
requirements may include, but ars not limited to, denial of certain
operations, shortenin.q or rsducin.q the size of structures, and increasinq
the width of non-disturbance buffers
[7] Whether the dock will result in the destruction of or prevent the growth of
vegetated wetlands, seagrasses including eelgrass (Zostera marina) and
widgeon grass (Ruppia maritima or shellfish;
[11] Whether the cumulative impacts of a residential and commercial dock will
change the waterway or the environment and whether alternate design,
construction, and location of the dock will minimize cumulative impacts; and
[12] Whether adequate facilities are available to boat owners and/or operators
for fueling, discharge of waste and rubbish, electrical service and water service.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action

All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Water~ont Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
