paid by the party of the second part does hereby remise, release and quitclaim unto the party of the second
part forever ALL THAT CERTAIN PLOT, PIECE OR PARCEL OF LAND, WITH THE
BUILDINGS AND IMPROVEMENTS THEREON ERECTED, SITUATE, LYING AND BEING IN:
the Hamlet of Orient, Town of Southhold, Suffolk County, New York, as more particularly described on
Schedule "A" attached hereto and made a part hereof.

right, privilege and easement to use, operate, repair, protect and maintain, but not improve or expand, the
existing irrigation pond and earthen dike located on the lands conveyed to the People of the State of New
York, by deed recorded in the Office of the Clerk of Suffolk County at Liber 10974 of Deeds, Page 203
(the "Wetlands"); and in connections therewith the right of ingress, egress and regress across the Wetlands
provided, however, that nothing herein contained shall be construed as relieving the party of the second
part of the obligation of securing all necessary approvals of any governmental agency having jurisdiction,
including the NYSDEC pursuant to Article 25 of the Environmental Conservation Law. Said reservation
shall remain in force and be in effect for so long as the lands conveyed hereby (subject to an easement
owned by the County of Suffolk recorded in the office of the Clerk of Suffolk County in Liber 9378 of
Deeds at Page 347) shall be wholly or partially used for agricultural purposes and practices as the same
are defined by the provisions of the Agriculture and Markets Law.

of a certain negative covenant reserved in the deed conveying the Wetlands whereby the Grantee of said
Wetlands, its successors and assigns agrees that it shall not allow any use of the Wetlands which would be
inconsistent with the maintenance of the integrity of the earthen dike, irrigation ponds and wetlands,
recognizing that the economic viability of the premises conveyed hereby is dependent upon the physical
condition of the Wetlands.
All as shown on a certain map entitled "Map of Lands to be acquired Pursuant to Section 3-0305
of the Environmental Conservation Law, Project Q-TWL Suffolk 13, Long Beach Bay Tidal Wetlands,
situate in Orient, Town of Southold, County of Suffolk, State of New York, dated 11/22/88 by Howard
A. Young, licensed land surveyor, N.Y. Reg. No. 45893 and filed in the office of the Department of
Environmental Conservation at Albany, New York as Map No. 10646, Sheets 2, 3, 4, 8, & 9 of 16.
16119 and intended to convey those same lands subject to Suffolk County Development Rights
Easement L.4564 C.P. 566 consisting of 117 acres, more or less, and also identified as tax map number
1000-19-1-7.4

This conveyance is made subject to public utility easements and easements, covenants and
restrictions of record affecting said premises, if any.

heirs or successors and assigns forever. The word "party" shall be construed as if it read
"parties" whenever the sense of this indenture so requires. This deed is subject to the trust
