Box 447 Quogue, NY 11959-0447 RE: CLEMENT CLEVELAND IV WINTHROP DRIVE, FISHERS ISLAND SCTM# 9-10-1 Dear Mr. Just: The Southold Town Board of Trustees reviewed the site plan prepared by CME Associates Engineering, Land Surveying & Amhitecture, PLLC, last dated September 30, 2008, and received on April 20, 2010, and determined that the construction of a proposed single-family dwelling, sanitary system, patio, drive and parking area is out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code. Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111 ) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 100' landward from the top of the bluff, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. The site is located on the opposite side of Winthrop Drive (paved road) for the nearest area of wetlands( Silver Eel Cove). The proposed dwelling, sanitary system, patio parking area and most of the drive is located greater than 10ft from the wetlands associated with Silver Eel Cove and a 12' x 35' section of the proposed gravel drive is located within 100' of the wetlands. For the Board's review I have enclosed an application in which I have requested an administrative permit for the section of drive located within the trustee's jurisdiction and have also requested a Letter of Non-jurisdiction for the rest of the proposed work. For the Board's review I have enclosed a copy of the survey/plans for the project, recent photographs and photo key and a copy of the survey/plans on which I have drawn in red ink the 100' setback line.
