TOGETHER with all rights of way and easements for street, beach rights and other purposes, conveyed by Gardiners Bay Company, Inc. to Herbert E. Meyer and Rebecca Ann Meyer by Deed dated DrSf to° J May 27 , 1947 recorded in the Suffolk County Clerk' s office in Sec. 037 Liber 2718 Page 86 on June 1 , , 1947 , and by Deed from C. Nelson Se Se 37 Hicks, Florence Hicks, his wife, and Gladys D. Hicks to the said Lot 019 Herbert E. and Rebecca Ann Meyer, dated July 26, 1945 and recorded in Liber 2481 of Deeds, Page 387 , on September 11 , 1945 , and SUBJECT to the,, reservations and covenants of restrictions as set forth in a 'certain Deed made by Gardiners Bay Company to Milton N. Hicks and 0; Nelson Hicks, dated March 14 , 1928 and recorded in the Suffolk County Clerk' s Office in Liber 1847 of Deeds, at Page 450 , on January 30 , 1936 . BEING the same premises conveyed to Charles L. Westenberg and Jean F. Westenberg, his wife (now both deceased) by Deed dated September 9, 1960, recorded in the Suffolk County Clerk ' s Office on September 20,1960 in Liber 4876 of Deeds, Page 497 TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, and also all the estate which the said decedent had at the time of decedent's death in said premises, and also the estate therein, which the party of the first part has or has power to convey or dispose of, whether individ- ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered am-thing whereby thersaid premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
