TRUST AGREEMENT dated May 6, 1996

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and

being in the Township of Southold, Suffolk County, State of New York, bounded and
described as follows:
BEGINNING at a point on the line of ordinary high-water of Long Island Sound, distant
six hundred (600) feet easterly measured along said high-water from land formerly owned
by E.H. Dallett, which beginning point adjoins land heretofore conveyed to Irma McKay
Jayne] running thence along the land of said Irma McKay Jayne, south twenty (20) degrees
and twenty (20) minutes east five hundred and thirty-eight and ninety-five hundredths
(538.95) feet; thence north, fifty-five (55) degrees, seventeen (17) minutes and twenty
(20) seconds east two hundred and twenty-eight and eighty-two hundredths (228.82)
feet; thence north, twenty-four (24) degrees, four (4) minutes and thirty (30) seconds
west, four hundred and ninety-seven and ninety-four hundredths (497,94) feet to the
ordinary high-water of Long Island Sound; thence south, along the ordinary high-water
of Long Island Sound, south sixty-three (63) degrees, twenty-six (26) minutes and ten
(10) seconds west one hundred and forty-three and thirty-three hundredths (143.33)feet;
District 1000 thence south, still along said high-water line, south seventy (70) degrees, thirty-eight
Section 23 : (38) minutes and fifty (50) seconds west forty-six and sixty-seven hundredths (46.67)

TOGETHER with an easement or right of way over a strip of land seven and one-half
(71) feet wide immediately adjoining said plot on the west. Subject to an easement
or right of way over a strip of land seven and one-half (71) feet wide immediately adjoining
on the east the westerly line of said plot, said right of way to be used in common as
a private road to the Sound.
TOGETHER with an easement or right of way over a strip of land fifteen (15) feet wide
leading from the highway to said plot, said right of way designated in a Deed from Walter
G. Fisher and wife to Ezra H. Young, dated the 27th day of December, 1922, and recorded
in the Office of the Clerk of Suffolk County on the 19th day of January, 1923, in Liber
1064 of Conveyances at Page 105.
SUBJECT to the covenants and restrictions contained in former deeds of record affecting
this property.
BEING the same premises conveyed to the Grantor herein by Deed dated the 8th day of
September, 1987 and recorded in the Office of the Clerk of Suffolk County on the 18th
day of November, 1987 in Liber 10472 of Deeds at Page 511.
