SALMINEN, residing at 100 Seminole Avenue, Massapequa, NY 11758, party of the first part, and PAULETTE PETERSON and MARK A. NACHMIAS, residing at 55 East 2nd Street, Apt. 3, New York, NY 10003, as joint tenants, party of the second part, Witnesseth, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, All that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Village of East Marion, Town of Southold, County of Suffolk and State of New York, being more particularly bounded and described as follows: BEGINNING at a concrete monument set in the southerly side of a Right of Way, distant the following two courses and distances, as measured along the southerly side of said right of way, from its intersection with the easterly side of Bay Avenue; 1. North 55 degrees 47 minutes 20 seconds East, 140 feet; 2 . North 64 degrees 53 minutes 50 seconds East, 92 .37 feet; RUNNING THENCE from said point of beginning, North 55 degrees 47 minutes 20 seconds East along the southerly side of said right of way, 40 feet to a monument and land of George Gogates; THENCE South 43 degrees 19 minutes 40 seconds East along said last mentioned land and through a monument 144 feet to the shoreline of Marion Lake; THENCE Southerly along the shoreline of Marion Lake a tie line course and distance of Southold 14 degrees 41 minutes 20 seconds West, 46 .56 feet to land of Walter Robinson (former of Laura Moore) ; THENCE North 43 degrees 19 minutes 40 seconds West along said last mentioned land and through a monument 175 feet to the concrete monument set in the southerly side of said right of way at the point or place of BEGINNING. together with a right of way over a private road from the easterly side of Bay Avenue to the easterly side of the premises. SUBJECT to and together with the benefits contained in deed dated January 24— 1983 from Edna A. Brown to Russell DiFrancisca and others and which was recorded in Liber 9310 cp 461 and together with a 1/13 interest in and to the premises described in said deed. BEING AND INTENDED TO BE the same premise conveyed to the grantor herein and her husband, Christian B. Salminen, deceased in deed dated September 24, 1986, recorded on December 8, 1986 in liber 10186, cp 24 . Christian B. Salminen died on June 5, 1989. Together with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; Together with the appurtenances and all the estate and rights of the party of the first part in and to said premises; To Have and to Hold the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. And the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. And the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
