ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at East Marion,Town of Southold, County of Suffolk and State of New York, known and designated as Lot No. 28 on a certain snap entitled"Map of Highpoint at East Marion, Section One",and filed in the Office of the Clerk of the County of Suffolk on 1/11/1994 as Map No. 7680,Abstract No. 9537. SUBJECT to covenants and restrictions of record, and ten-foot(10')utility easements along front and side lot fines. BEING the same premises conveyed to the grantor herein by deed dated May 24, 1985, recorded June 5, 1985 in Liber 9 R04 page 12. SAID PREMISES also known as 2295 Cedar Drive, East Marion, NY 11939, and as District 1000, Section 022.00, Block 05.00, Lot 028.000. SUBJECT to state of facts an accurate survey would show and agreements, easements and variations of record. SUBJECT to a Life Estate retained in ROSE MARIE CEPARANO. SUBJECT to Grantor, ROSE MARIE CEPARANO `s Limited Power to Appoint, in whole or in part, the property conveyed hereunder to or for the benefit of anyone or more of the Grantor's issue in such proportions, outright or upon such trusts,terms, and conditions as the Grantor may specify by a writing executed and acknowledged during his lifetime and recorded in the Suffolk Comity Registry of Deeds within sixty(60)days of the date of such exercise,or by her Last Will or Codicil making specific reference hereto. In the latter case, failure to record notice of any such exercise of this power in the Suffolk County Registry of Deeds within sixty(60)days of the Grantor's death shall be conclusively treated as a default in the exercise of the power. A release of the power reserved hereunder,in whole or in part,shall be effective when recorded with the Suffolk County Registry of Deeds. Any exorcise or release of the foregoing powers may be made by the Grantor's attorney-in-fact mrder a durable power of attorney. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof,TOGETHER with the appurtenances and all the estate and rights of the party of the first pad in and to said premises;TO HAVE AND TO HOLD the premises herein granted unto the party of the secondpart,the hetes or successors and assigns of the party of the second part forever. AND the party of the first part, in compliance with Section 13 of Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fluid to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the paymrnnt of the cost of the improvement before using any part of the total of the same for any other purpose. AND the party of tine first part covenants as follows: that said party of the first part is seized of the said premises in fee simple, and has good right to convey the same; that the party of the second part shall quietly enjoy the said premises; that the said premises are free from encumbrances, except as aforesaid;that the party of the fust part will execute or procure any further necessary assurance of the title to said premises;and that said party of the first part will for warrant the title to said premises. The word"party" shall be construed as if it read"parties"whenever the sense of this indenture so requires.
