Box 1179 Southold, NY 11971-0959 FINDINGS, DELIBERATIONS, AND DETERMINATION MEETING HELD APRIL 14, 2009 ZBA FILE # 6263 - FRANK and DIANE PALILLO, Applicants Property Location: 7433 Soundview Avenue, Southold (at Great Pond) CTM 59-6-5.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category, on the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply received 1-12-2009 that states this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was found to be consistent under Town Code Chapter 268, which is also the recommendation of the Town LWRP Coordinator in a letter dated March 18, 2009 submitted to the Board of Appeals. PROPERTY FACTS/DESCRIPTION: This parcel is a non-conforming lot containing less than 20,000 square feet. The property is improved with a 1~ story frame home built approximately 40 years ago. The home fronts on a private road and the rear yard of the home fronts On Great Pond in Southold, as shown on the 04/08/2008 survey prepared by Nathan Corwin, Land Surveyor with the location of the home. BASIS OF THE APPLICATION: Zoning Code Sections 280-116-C and 280-124, based on the Buildings'Inspector's December 2, 2008 Notice of Disapproval concerning proposed additions and~alterations to the existing single-family dwelling, which new construction will be less than tile code-required minimum of 35 feet for a rear yard setback and less than 75 feet from Great Pond (freshwater boundary). The Building Department states that the setback will be 33 feet from the bulkhead for the deck reconstruction, and 40 feet to the bulkhead for the proposed second-story addition. FINDINGS OF FACT RELIEF REQUESTED: The proposed and existing 'second-story addition will be/is 40 feet to the bulkhead and the deck construction will be 33 feet to the bulkhead. The addition will CTM 59-6-5.1 · ¥/ include an existing dormer on the second story on the water side of the home, along with a 5.2' x 7.5' deck off the master bedroom. The additions to the second-story roof, facing the private road, include the construction of three dog-house dormers measuring 8 feet in width, spaced 11 feet apart, details as shown on the 3/16/2009 pl0t plan map prepared by Robert O. Barrett, P.E. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town La~v ~267-b(3)(b}(3)(D. Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This construction is proposed on the original footprint of the existing foundation. The only exception is ~: small addition to the garage and the small second deck as proposed on the plans submitted by the engineer, shown as drawing #12068. The proposed additions do not affect the existing non-conforming set back from Great Pond at 33 feet. It is also noted that nine properties have frontage on Great Pond - four of which are larger than tiie subject property and the remaining other three parcels are smaller in area. . and one parcel (CTM 9) is of similar size to the subject property. 2. Town Law §267-b(3}(b}(2}. The benefit sought by the applicant cannot be achieved by some method; feasible for the applicant to pursue, other than an area variance. The size of the lot is non-conforming at .335 acres. The home, on its original footprint is placed in the center of the parcel. The applicants' do not which to change this footprint, any alterations on the waterfront side of the subject property will be on the existing second story of the dwelling. 3. Town Law §267-b(3)(b)(3L The amount of relief requested is substantial based upon present Code~equirement of 75' from the existing bulkhead. The existing non-conforming setback represents a 56% reduction from current Code requirements. The home has been in its present location for the past 35 years. 4. Town Law~267-b(3)(b)(5). The difficulty has not been self created. 5. Town Law ~267-b(3)(b}(5}. There is no evidence to show that the grant of the requested relief will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood. A March 19, 2009 letter was submitted by the Suffolk County Soil & Water Conservation District stating that there is no erosion evident, and that a recent site visit found the bulkhead and wooden dock appeared to be in excellent condition. It was also noted that no natural resource concerns were observed during their site visit. 6. Town Lav~"§267-b. Grant of relief with conditions as noted below is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage, while preserving and protecting the character of the neighborhood and the health, safety and welfare og the community. ~age 3 -April 1~ 2009 ZBA F/le # 6263 - Fr~-~ and Diane Psl/llo CTM 59-6-6.1 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Oliva, seconded by Member Weisman, and duly carried, to GRANT the variance as applied, as shown on the 3/16/2009 plot plan map prepared by Robert O. Barrett. P.E. subiect to the following Conditionn: 1. AIl roof run off, must be contained by the use of down spouts and gutters and placed in code conforming drywe~is. 2. Non-turf buffer must be 10' in width and run the entire distance of the bulkhead, as shown on survey provided by agent for the applicants. o Existiog first-story deck should be inspected for stability by the Building Inspector. If deemed unstable, it must be reconstructed to present construction standards and re-inspected by the same. That the abo~9 conditions be written into the Building Inspector's Certificate' of Occupancy, when issued. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property thai may violate the Zoning Code. other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimus in nature for an alteration that does not increase the degree of nonconformity. Cost estimate for proposed re- modelling Dear Frank, Further to my letter dated 3/20/09 where I indicated that I expected the cost of the proposed re-modelling would be in the range 200 to 2505/sq ft. I have now reviewed the bill of materials and cost break-down data provided by your preferred conlxactor. The Grand Total is $162,216.00. While the breakdown is comprehensive and this figure contains adequate contingency and profit to cover the contractor's risk, it does not include the supply of the new fxont door and new carpet in the second story bedrooms, for which you will contract separately, but is required to obtain the Certificate of Occupancy. Adding your estimate of $3000 to cover these items yields an adjusted re-modelling cost to you of $165,216 or $236/sq ft. While this price is at the upper half of my price range, it is very important to me that you have expressed confidence in the competence of this contactor, based upon your past experience. Accordingly I certify that the figure of $165,216 is an appropriate sum for the proposed work to be conducted by this contractor, as demonstrated by my signed and dated NY PE Seal attached hereto. Cost estimate for proposed re- modelling Dear Frank, The proposed re-modelling that is planned consists of a two story addition to the subject existing cape, which in total mount to slightly less than 700sq ft. The work will involve removing part of the existing roof, enlarging one bedroom, adding a new bedroom, and enlarging the ftrst floor living area by building into the existing garage. No new bathrooms or kitchen changes are planned and all existing appliances, heating furnace and hot water equipment will be re-used. The cost of such work will depend upon the quality of finishes etc, requested and the degree of difficulty anticipated. In my recent experience, builders charge between $200 and $250 per square foot to handle such work on a turnkey basis. The following is the kind of cost break-down that I would expect to see in the circumstances: Item $ Materials and sub contractors 60,000 Labor 60,000 Subtotal 120,000 Contingency and gross profit 630% 36,000 Selling Price 156,000 In this case the estimated cost is 2235/sq.ft. It is possible that there are some cost savings available depending upon the work scope and type of contract you enter into with your selected contractor, but in the circumstances I believe that the above cost estimate should be used for your immediate planning purposes. Proposed re-modelling References: Uniform Residential Appraisal Report by Eugene M. Foy State Cert # 4500046833, previously submitted Dear Ms Toth, Thank you for the opporttmity to provide additional information in support of our application for a Building Permit for the subject premises. I have now reviewed the bill of materiais and cost break-down data provided by the client's selected contractor. The Grand Totai is $162,216.00. While the breakdown is comprehensive and this figure contains adequate confmgency and profit to cover the contractor's risk, it does not include the supply of the new fi~ont door and new carpet in the second story bedrooms, for which my client will contract separately, but is required to obtain the Certificate of Occupancy. Adding my client's estimate of $3000 to cover these items yields an adjusted re- modelling cost of $165,216. While this price is in the upper haif of my expected price range, it is very important to me that the client has expressed complete confidence in the competence of his contactor, based upon his past experience. Accordingly I have certified in a previous submission that the figure of $165,216 is an appropriate sum for the proposed work to be conducted by this contractor. I would now like to direct your attention to the referenced Appraisal Report. My review leads me to conclude that the appraiser has done a thorough job and his conclusions accurately reflect the specific situation. In summary, the appraiser finds that the gross vaiue of the property lies between $735,000 and $747,330 on the basis of six comparable saies and his cost anaiysis respectively. The cost analysis portion of the appraisal states that the gross vaiue associated with the house aione is 49.8% of the total vaiue, which then yields a net vaiue for the house alone in the price range $366,000 to $372,000. This price range compared with the above proposed re-modelling cost of $165,216, shows that the re-modelling cost is substantially less than half the value of the house alone. According my conclusion is that the proposed re-modelling is not substantial in nature, as demonstrated by my signed and dated NY PE Seal attached hereto. Respectfully submitted, R. O. Permissible cost of renovations Dear Frank, The subject property consists of 4 bedrooms and two bathrooms with living room, dining room and one car garage located on 0.335 acre waterfront lot facing Great Pond. During the past year seven comparable but non waterfront homes closed at an average price of $470,000, of which possibly $100K is the cost of the land, leaving $370K for the cost of the house. During the past three months one 1.85 acre vacant waterfront lot has closed and the final selling price was $290,000. If this had been 0.33 acre the price would have been substantially less i.e. $100K. Since this was an un-improved lot to make it comparable to the subject property, one must add the value of the bulkheading ($60,000) and the dock ($4000) raising the total worth to $165,000 The actual selling price of the house last November was $700,000, and less the $165,000, this leaves $535K for the value of the home During the same period another waterfront property closed for $999,000 on a slightly larger property. However it goes a long way to confirming that the $700,000 paid was a fair price. The subject property has above average details, i.e. granite countertops, new appliances and kitchen counters, Victorian pedestal basins, hardwood floors, etc. These features help place the subject property near the top of the price range. Conclusion: The value of the subject house without the land, waterview, bulkheading and dock lies in the range $370K to $535K and because of the appointments, it is close to the top of this price range Sincerely, Robert Barratt NY State Licensed Realtor Salesperson :~ NY State Licensed Professional Engineer Cell 631 875 0275 Fax 631 734 2730 Prepared by Robert Barratt Prudential Douglas EIliman RE 41312009 10:38:35 AM Size: .44 Zoning: Residential Pose Subdiv: Mattituck Bosworth Zoning:Residential Contract Date:2/23/2009 Poss Subdlv:Y Title Date:3/24/2009 Sold Price:$250,000~ List Price: Last Statu~ Change: C Days on Mkt:70 tiPIcts: Waterfront:N ML#:2083700 List price: Last ~ Days on Mkt:377 #Plots: Selling Broker: Prudential Douglas Ellim~n 631-298-8000 Waterfront:Y Listing Broker: Andrew Stype Realty Inc 631-298-8760 ML#:2047861 Lagoon Ct, S.
