` O THIS INDENTURE, made the 3%3 day of October, nineteen hundred and ninety-six
BETWEEN
MARGITTA G. WAHRENBURG a/k/a MARGITTA WAHRENBURG, residing at 184 North
Main Street, Walton, Kentucky, 41094, and JULIA M. MANN, residing at 132 Mystic Road,
North Stonington, Connecticut, 06359, as joint tenants with the right of survivorship
party of the first part, and
JOSEPH LICCIARDI and CATHERINE E. PINO, residing at 402 Bayridge Parkway, Brooklyn,
New York, 11214
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold, County of Suffolk and State of New
York, known and designated as Lot No. 5 on a certain map entitled, "Map of Marion Manor
situated in East Marion, Town of Southold, Suffolk County, owned and developed by Peter Blank
& Son, East Williston, New York, surveyed by Otto R. Van Tuyl and Son, Licensed Surveyor,
Greenport, New York on November 25, 1952" and filed in the Office of the Clerk of the County
of Sufl.'olk on March 18, 1953 as Map No. 2038, being more particularly bounded and described
according to said map as follows:
BEGINNING at a point on the southerly side of Cleaves Point Road and the dividing line
between Lot 5 herein and the easterly line of Long Island Oyster Farms, Inc.;
RUNNING THENCE along the southerly side of Cleaves Point Road, North 64 degrees 51
minutes 10 seconds East, a distance of 85 feet;
RUNNING THENCE south 25 degrees 08 minutes 50 seconds East, along the dividing line
between Lots 5 and 4 a distance of 326 feet;
RUNNING THENCE south 27 degrees 01 minutes 30 seconds West, a distance of 107.61 feet;
RUNNING THENCE north 25 degrees 08 minutes 50 seconds West, along the dividing line
between lot 5 and Long Island Oyster Farms, Inc., a distance of 392 feet to the southerly side of
Cleaves Point Road, the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the parties of the first part by
deed dated December 1, 1983 recorded in the Office of the Clerk of the County of Suffolk on
December 13, 1983 in Liber 9474 page 528.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of tfie first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party oCthe first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREO a party of the first part has duly executed this deed the day and year
first above written.
