Clark, Two hundred and thirty-five (235) feet and, on the West by land formerly of John J. Bartlett and others, fifty (50) feet. Together with a right of way over the Road known as Old orchard Lane. Being and intended to be the same premises conveyed to the party of the first part by deed dated March 30, 1988, recorded in the Suffolk County Clerk's Office in Liber 10580, page 574 . PARCEL II ALL that certain lot or plot of land situate at East Marion in the Town of Southold, in the County of Suffolk, State of New York, lying on the easterly side of a certain road or lane known as Old Orchard Lane, bounded as follows: On the westerly side thereof by said Old Orchard Lane, on the northerly side by land of Joseph Getches, formerly of Jacob Busch, easterly by land now or formerly of Antoine Furst, and southerly by land of Julia Makara, the said party of the second part. Said plot being about sixty (60) feet more or less, front and rear. Together with all the right, title and interest of the party of the first part of, in and to that part of Old Orchard Lane lying immediately in front of said premises to the center line thereof, subject to its use as a public street or highway. Being and intended to be the same premises conveyed to the party of the first part by deed dated March 30th, 1988, recorded in the Suffolk County Clerk's Office in Liber 10580, page 574 . TOGETHER with all right, title and. interest, if any, of the party of the first part, in and to any streets and roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
