HomeMy WebLinkAboutL 11835 P 960 Sci7lCN 6LOGK LOT.,:; ; P9&0 DISTRICTSECTION []= L= Standard N.Y.B.A.U.Form 8001 Bargain and Sale Dad,without covenants against Grantor's AcG-Individual or Cmporatiao(single sheet) THIS INDENTURE, made the ctS' day of 1997 BETWEEN Julia Makara, residing at 407 Kent Avenue, Bridgeport, Connecticut 06610 party of the first part, and JULIA MAKARA, residing at 407 Kent Avenue, Bridgeport, Connecticut 06610 and ANDREW MAKARA, her brother, residing at 407 Kent Avenue, Bridgeport, Connecticut, as joint tenants with rights to survivorship, party of the second part, WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or succeeaors and assigns of the party of the second part forever, PARCEL I ALL that certain plot, piece or parcel of land with the buildings and improvements thereon erected, situate, lying and being in the Village of East Marion, Town of Southold, County of Suffolk and State of New York and Bounded and described as follows: Northerly by land formerly of Gottfried Arnold, two hundred and thirty five (235) feet; Easterly by land now or formerly of Anton Furst, Fifty (50) feet; Southerly by land now or formerly of James P. Clark, Two hundred and thirty-five (235) feet and, on the West by land formerly of John J. Bartlett and others, fifty (50) feet. Together with a right of way over the Road known as Old orchard Lane. Being and intended to be the same premises conveyed to the party of the first part by deed dated March 30, 1988, recorded in the Suffolk County Clerk's Office in Liber 10580, page 574 . PARCEL II ALL that certain lot or plot of land situate at East Marion in the Town of Southold, in the County of Suffolk, State of New York, lying on the easterly side of a certain road or lane known as Old Orchard Lane, bounded as follows: On the westerly side thereof by said Old Orchard Lane, on the northerly side by land of Joseph Getches, formerly of Jacob Busch, easterly by land now or formerly of Antoine Furst, and southerly by land of Julia Makara, the said party of the second part. Said plot being about sixty (60) feet more or less, front and rear. Together with all the right, title and interest of the party of the first part of, in and to that part of Old Orchard Lane lying immediately in front of said premises to the center line thereof, subject to its use as a public street or highway. Being and intended to be the same premises conveyed to the party of the first part by deed dated March 30th, 1988, recorded in the Suffolk County Clerk's Office in Liber 10580, page 574 . TOGETHER with all right, title and. interest, if any, of the party of the first part, in and to any streets and roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
