HOGAN, residing at 30 Hollywood Ave. , Lynbrook, NY 11963, as joint tenants with the right of survivorship party of the second part, b S-1.r CT S.r-.CiiOV Dist. 1000 ��// LOTSec. 037.00 /Om Blk. 01.00 /� i ,M t i Lot 006.000 ) WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at East Marion, in the Town of Southold, County of Suffolk, State of New York, which plot is known as and by the lots numbered one hundred two (102) and one hundred three (103) as shown on a map entitled "Map of Section Two Gardiner' s Bay Estates, situate at East Marion, Long Island", which map was filed in Suffolk County Clerk's Office on September 23rd, 1927, under the number 275. THIS DEED IS SUBJECT TO the life use and occupancy of the premises by the party of the first part and ROBERT F. HOGAN, residing at 30 Hollywood Ave. , Lynbrook, NY 11563, or the survivor. THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF APPOINTMENT, exercisable as often as she may choose, to change the remaindermen as follows: to or among any one or more members of a class consisting of the party of the first part' s descendants, in any degree, whether presently living or born hereafter, in such proportion and amounts, without regard to equality, outright or in trust, as the party of the first part may direct and appoint during her lifetime by a properly written and acknowledged instrument, and recorded prior to death, making specific reference to this power of appointment. The party of the first part may not appoint herself, her estate, her creditors or the creditors of her estate, under any circumstances. BEING AND INTENDED TO BE THE SAME PREMISES CONVEYED TO THE PARTY OF THE FIRST PART BY DEED DATED 7/19/86 AND RECORDED ON 7/29/86 AT THE OFFICE OF THE SUFFOLK COUNTY CLERK IN LIBER 10088 CP 363. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the 11840 093 premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the part of the first part, in compliance with Section 13 of the Lien law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply (lie same first to the payment of line cost of the improvement before using any part of file total of the same for any other purpose.
