THIS INDENTURE, made the 17th day of Jafielynineteen hundred and ninety-seven

HOPE T. GILLISPIE f/k/a HOPE T. WHITSIT f/k/a HOPE T. TERRY, residing at no #
Main Road, Orient, New York, 11957
party of the first part, and
DIANE W. WHITSIT, residing at 19 Cullinane Drive, Marlboro, Massachusetts, 017rt2
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever, her
undivided one-half interest in and to

ALL THAT CERTAIN plot, piece or parcel of land, situate, lying and being at Orient, in the
Town of Southold, County of Suffolk and State of New York, more particularly bounded and
described as follows:-
BEGINNING at the southeasterly corner of the premises herein described said corner being
779.44 feet from the westerly line of Greenway East and the northerly line of Main Road (Route
25);
RUNNING THENCE South 77 degrees 34 minutes 00 seconds West 382.31 feet to land now or
formerly of Lloyd Terry;
RUNNING THENCE North 12 degrees 33 minutes 50 seconds West 596.28 feet to other lands
of the party of the first part;
RUNNING THENCE North 77 degrees 35 minutes 30 seconds East 397.72 feet to land now or
formerly of Joyce Terry.
RUNNING THENCE South 11 degrees 05 minutes 00 seconds East 596.28 feet to the point or
place of BEGINNING.
BEING AND INTENDED TO BE part of the same premises conveyed to the party of the first
part by deed dated January 8, 1973 and recorded in the Office of the Clerk of the County of
Suffolk on February 13, 1973 in Liber 7342 page 308.

ALL THAT CERTAIN plot, piece or parcel of land, situate, lying and being at Orient, in the
Town of Southold, County of Suffolk and State of New York, more particularly bounded and
described as follows:-
BEGINNING at the southeasterly corner of the premises herein described said corner being
779.44 feet from the westerly line of Greenway East and the northerly line of Main Road (Route
25);
RUNNING THENCE South 77 degrees 34 minutes 00 seconds West 382.31 feet to tl a true
point or place of BEGINNING;
RUNNING THENCE North 12 degrees 33 minutes 50 seconds West 2052.44 feet to, more or
less, to the ordinary high water mark of Long Island Sound;
RUNNING THENCE North 77 degrees 16 minutes 50 seconds East 450.82 feet, more or less, to
land now or formerly of Joyce Terry.
RUNNING THENCE South 11 degrees 05 minutes 00 seconds East 2055.43 feet, more or less,
to other lands of the party of the first part; and
RUNNING THENCE North 77 degrees 35 minutes 30 seconds East 397.72 feet to the true point
or place of BEGINNING.
BEING AND INTENDED TO BE part of the same premises conveyed to the party of the first
part by deed dated January 8, 1973 and recorded in the Office of the Clerk of the County of
Suffolk on February 13, 1973 in Liber 7342 page 308 and the same premises wherein certain
development rights were conveyed to the Town of Southold by deed dated October 5, 1993
recorded in Liber 11648 page 728.
RESERVING, HOWEVER, a legal life estate in the above-described premises with the buildings
and improvements thereon erected, in and to the parties of the first part.
THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT, exercisable as often as she may choose, to change her remaindermen as
follows:
TO or among any one or more members of a class consisting of the party of the first part's
descendants, in any degree, whether presently living or born hereafter, in such proportions and
amounts, without regard to equality, outright or in trust, as the party of the first part may

direct and appoint during her lifetime by a property written and acknowledged instrument, and
recorded prior to death, making specific reference to this power of appointment. The party of
the first part may not appoint herself, her estate, her creditors or the creditors of her estate,
under any circumstances.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year
first above written.
