SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II category
of the State's List of Actions, without further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required
under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County
Department of Planning issued its reply dated January 10, 2010 stating that this application is
considered a matter for local determination as there appears to be no significant countywide or
inter-community impact.
LWRP: This application has been reviewed under Chapter 268, Waterfront Consistency review
of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP)
Policy Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to us, it is our
recommendation that the proposed action is EXEMPT from LWRP coastal consistency review
requirements pursuant to Section 268-3, and confirmed by the LWRP Coordinator by a letter
dated February 8, 2010.
PROPERTY FACTS/DESCRIPTION: Parcel is improved with a one-story frame home which is
placed approximately in the center of this non-conforming creek front lot consisting of 19,435.57
sq. ft. with 75 feet of frontage on Hobart Avenue, 262.42 feet along the southeast property line,
75.29 feet along Town Creek and 255.86 feet along the northwest property line. The survey
shows an existing accessory garage in the front yard.
BASIS OF APPLICATION: Request for Variances from Code Section 280-124, based on an
application for building permit and the Building Inspector's October 8, 2009 Notice of
Disapproval concerning proposed construction of an accessory two car garage, (1) less than the

code required front yard setback of 35 feet, (2) less than the code required side yard setback of
20 feet, at 2550 Hobart Rd., Southold, NY. CTM#64-3-8.
RELIEF REQUESTED: The applicant requests relief code section Art. III, section 280-15 (B)(F),
"accessory buildings; on lots 10,000 to 19,999 sq. ft. shall have a minimum side yard setback of
20 feet and in the case of waterfront properties, accessory buildings may be located in the front
yard provided the meet the principal front yard setback... The principal front yard setback for
this lot is 35 feet. The present survey indicates a proposed side yard setback of 3.1 feet and a
front yard setback of 20.8 feet, for a proposed 575 square foot two car unheated accessory
garage
ADDITIONAL INFORMATION: The applicant submitted a survey to the Building Department
showing the enlargement of the existing garage in the same nonconforming location. At the
Public Hearing, the applicant indicated that the garage was razed and removed from its' location
last year, and agreed to alternative relief in order to locate the proposed accessory garage with
slightly more conforming front yard and side yard setbacks.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on April 22, 2010, at
which time written and oral evidence were presented. Based upon all testimony,
documentation, personal inspection of the property, and other evidence, the Zoning Board finds
the following facts to be true and relevant and makes the following findings:
On the basis of testimony presented, materials submitted and personal inspections, the Board
makes the following findings:
1. Town Law §267-b(3)(b)(1 }. Grant of alternative relief will not produce an undesirable change
in the character of the neighborhood or a detriment to nearby properties. There are several
accessory buildings in the neighborhood that are located in the front yard as close or closer to
the street than the applicant's proposed location. The applicant also co-owns the adjacent
property and an accessory garage has been on his property in the proposed location for many
years. No neighbors spoke for or against the application.
2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some
method feasible for the applicant to pursue, other than an area variance. The applicant could
place the proposed new garage in several more conforming locations, other than the proposed
location. The applicant proposes to locate an accessory garage in the southeast corner
of his lot, which contains almost 20,000 sq. ft. with a length of 262.42 feet along the
southeasterly property line. The applicant could locate the proposed building at least 20
feet from the side yard making the side yard variance moot, and could also place the
structure in a more conforming front yard location by bringing the garage closer to his
home. However, that would place the proposed accessory garage in the center of the
applicant's lot and directly in front of the applicant's home, which is not aesthetically or
functionally desirable or characteristic of other accessory structures in the front yards
along Hobart Street.

3. Town Law §267-bi3)ibi{3). The variance granted herein is substantial; the variances
requested represent a 41% relief from the code required front yard setback, and an 84% relief
from the code required side yard setback. At the Public Hearing, the Board suggested an
alternate location, which is slightly more conforming to present zoning requirements.
4. Town Law §267-b(3}(b){4). No evidence has been submitted to suggest that a variance in
this residential community will cause an adverse impact on the physical or environmental
conditions in the neighborhood. An accessory garage has been in the proposed location for
many years and the property is fiat and has no drainage issues
5. Town Law §267-b(3)(b){5). The alleged difficulty has been self-created; the applicant could
propose an accessory garage in a location that would be more conforming to the current code.
6. Town Law §267-b. The Grant of Alternate Relief is the minimum action necessary to
enable this applicant to enjoy the benefit of a new accessory garage.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the
balancing test under New York Town Law 267-B, motion was offered by Member Dinizio,
seconded by Member Geohringer, and duly carried, to;
DENY, the application as Applied for, and shown on the survey prepared by Nathan T. Corwin,
dated 10/28/09, and GRANT Alternate Relief as follows:
The new garage with unheated storage above shall be setback from the southeasterly side yard
6 feet and the front yard setback from Hobart Avenue shall be 22 feet.
Subject to the following conditions:
1. The garage shall not exceed the code-required height of 18 feet.
2. The garage shall be unheated and unfinished and contain only electricity and one
outside hose bib.
3. The applicant is required to submit to the Zoning Board of Appeals office an updated
survey showing the stated setbacks prior to applying for a building permit.
4. The accessory garage will be fitted with gutters and leaders and will contain storm
water runoff on site in a drywell, as per town code
That the above conditions be written into the Building Inspector's Certificate of Occupancy,
when issued.
Before applying for a building permit, the applicant or agent must submit to the Board of
Appeals for approval and filing, two sets of the final survey and architectural drawings,
conforming to the alternative relief granted herein. The ZBA will forward one set of approved,
stamped drawings to the Building Department. Failure to follow this procedure may result in the
delay or denial of a building permit, and may require a new application and public hearing
before the Zoning Board of Appeals. This action does not authorize or condone any current or

future use, setback or other feature of the subject property that may violate the Zoning Code,
other than such uses, setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an
alteration that does not increase the degree of nonconformity.

proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard drea.
Before answering thc questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if' necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LTM policy
standards and conditions, it shall not be undertaken.
