THIS INDENTURE, made thef,day of December, nineteen hundred and ninety-eight BETWEEN, ALBERT G. COOK, residing at 321 Sixth Avenue, Greenport, NY 11944, as Executor of the last will and testament of ALICE BALDES, who died on the Ist day of January, nineteen hundred and nincty- eight, the party of the first pan, and RICHARD S, PILLES, residing at 65300 Route 48, Greenport, NY 11944, party of the second pan, Witnesseth, that the party of the first pan, to whom letters testamentary were issued by the Surrogate's Court, Suffolk County, New York on June 25, 199R, and by virtue of the power and authority given in and by said last will and testament and/or by Article I I of the Estates, Powers and Trusts Law, and in consideration of EIGHTY THOUSAND ($80,000.00) DOLLARS, paid by the party of the second pan, does hereby grant and release unto the party of the second pan, the distributees or successors and assigns of the party of the second pan forever, ALL THAT CERTAIN PLOT, piece or parcel of land with the buildings and improvements thereon erected, situate, lying and being at East Marion, Town of Southold, County of Suffolk and State of New York, bounded and described as follows:- BEGINNING at a paint on the easterly side of Cedar Drive distant 350.00 feet southerly along said easterly line from its intersection with the southerly side of Aquaview Avenue; THENCE running North 79 degrees 14 minutes 00 seconds East 120.00 feet to land now or formerly of Sauvigne', THENCE along said land, South 10 degrees 46 minutes 00 seconds East 100.00 feet to land now or formerly of Sakellis, THENCE along said land, South 79 degrees 14 minutes 00 seconds West 120.00 feet to the easterly side of Cedar Drive; THENCE atony the easterly side of Cedar Drive, North 10 degrees 46 minutes 00 seconds West 100.00 feet to the point or place of BEGINNING. TOGETHER WITH a right of way running with the land hereby described over a strip of land lying between the northerly line of Aquaview Avenue and tong Island Sound, more particularly described as follows: BEGINNING at the southwesterly corner of land heretofore conveyed to Alexander Lehrman and running thence westerly along said northerly line Aquaview Avenue, 45.00 feet to land of Stewart; thence along said land of Stewart, North 07 degrees 10 minutes 10 seconds West, 260.00 feet more or less to Long Island Sound, thence easterly along said Long Island Sound, 50.00 feet more or less; thence along said land of Alexander Lehrman, South 04 degrees 10 minutes 10 seconds East, 280 feet more or less to the point of BEGINNING. BEING AND INTENDED TO BE THE SAME PREMISES conveyed to George Battles and Alice Battles by deed from Alice Baldes dated 8!15/56 and rcorded in the Suffolk County Clerk's Office on 8/I6/56 in Liber 4162 page 421 and by deed from Edna A. Brown, dated. 3/22/52 and recorded in the Suffolk County Clerk's Office on 3/25152 in liber 3333 page 371. TOGETHER with all right, title and interest, if any, of the party ofthe first part in and to any streets and roads abutting the above described premises to the center line thereof, TOGETHER with the appurtenances, and also the estate which the said decedent had at the time of decedent's death in said premises, and also the estate therein, which the parry of the first part has or has the power to convey or dispose of, whether individually, or by virtue of said will or otherwise, TO HAVE AND TO HOLD the premises herein granted lotto the party of the second part, the distributees or successors and assigns of the parry of the second pan forever AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumhered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of improvement and will apply same first to the payment of the cost of improvement before using any part of the total of the same for any other purpose. The word "party" shall be conslnred as if it reads "parties' whenever the sense of this indenture so requires.
