Adoption of Meeting Minutes: ?? ACCEPTANCE OF MEETING MINUTES FROM MARCH 9, 2010 MOTION made by John Sepenoski, seconded by Eric Keil, to accept the Land Preservation Committee meeting minutes from March 9, 2010, as corrected. Motion carried: 5/0 (Lillian Ball not present for vote) Land Preservation Applications and Inquiries: ?? SCTM #1000-54-7-21.1 (Estate of Julia Conway) Update: re: contract [executive session]. John Sepenoski, LPC Chairman, was not present for a discussion on this project due to a family relationship. The members entered into EXECUTIVE SESSION. Confidential contract information discussed. LPC not favorable to granting landowner’s request for retaining 60 ft wide strip of land behind his residential home as it creates an irregularly shaped farming area. LPC is in favor of landowner retaining 50± ft wide area between his lot and another existing lot as this eliminates encroachment. LPC would consider landowner retaining entire area (approximately 3± acres) behind his house, however, covenants & restrictions limiting future residential development would likely be required. END OF EXECUTIVE SESSION ?? SCTM #1000-57-1-1 Inquiry from adjacent property owner re: potential preservation; discuss Supervisor’s inquiry. Supervisor requested additional information from LPC as to why Committee did not pursue preservation of the property. However, after Supervisor’s inquiry was made, coincidently a Storm Water Committee meeting was held at which John Sepenoski was in attendance. Sepenoski reported that Southold Shores was discussed at the meeting. It was suggested that the only possible solution for the area was a drainage plan for the entire area and that purchasing individual properties was not the solution. Supervisor Russell was at the meeting and agreed that an overall plan would be a potential solution and that there was no point in purchasing the subject lot at this point without an entire overall plan. ?? SCTM #1000-17-6-14.2; 1000-18-3-30.3; 1000-18-6-17.3 (Tuthill properties – South Dyer, LLC; North Brown, LLC and South Brown, LLC Appraisal review [executive session]. HOLD – not discussed due to time constraints. ?? SCTM #1000-63-3-18.1 (Scarola) New application. Committee members to do individual field inspections of this property prior to next LPC meeting. Applications & Inquiries for Uses or Structures on Preserved Property ?? SCTM #1000-100-4-3.2 (Shinn Estate Vineyard) [7:00 P.M.] Discuss potential to reconfigure Reserve Area with LPC Legal Counsel Lisa Kombrink, Esq. gave Land Preservation Committee information pertaining to the process to reconfigure the existing Reserve Area and alter the existing Easement Area. She advised that such a reconfiguration would constitute an alienation of the Town's existing development rights easement, and explained the legal process required for an alienation, including approval by the Town Board and approval at a mandatory referendum. Charles Cuddy, Esq. addressed the committee and noted that he believes that the reconfiguration would not constitute alienation but rather a transfer and exchange. He distributed a copy of letter of support for Shinn/Page proposal from the Long Island Wine Council, dated April 9, 2010. Melissa mentioned that she and LPC members had previously received an e-mailed letter of support for the Shinn/Page proposition from the North Fork Environmental Council. MOTION made by Eric Keil, seconded by Lillian Ball, that the Land Preservation Committee recommends that the Town Board proceed with the process to reconfigure the Reserve Area (SCTM#1000-100-4-3.1) in order to correct an inappropriate configuration of the Reserve Area. The Committee recommends providing landowner relief in the most expeditious way possible, subject to legal review, title report, survey showing no increase in reserve area or decrease in preserved area and appraisal showing commensurate value without loss of public value. Motion carried: 6/0 Stewardship and Management: ?? SCTM #1000-87-6-12.1 (Town Open Space: Blocker Property) VIOLATION: Encroachment from SCTM #1000-88-3-19 Not discussed due to time constraints. ?? SCTM #1000-57-1-43 (Town Open Space: Hurtado Property) VIOLATION: Encroachment from SCTM #1000-57-1-21 Damon Rallis, Town Code Enforcer, has been to visit site and neighboring landowner having received an anonymous complaint from a neighbor that someone was cutting down trees and digging drainage ditches on Town-owned parcel. Proposed Violator has contacted both Damon Rallis and Melissa Spiro, stating that tree on Town property had fallen during storm and was blocking drainage. He removed it from the property and put it out on the roadway for Town removal. Further investigation is needed. ?? UPDATE re: 3/23/10 TOWN BOARD WORK SESSION AGENDA ITEM RE: STEWARDSHIP AND STEWARDSHIP MEETING SCHEDULED BY SUPERVISOR FOR APRIL 1, 2010 AT 11:00 A.M. TOWN HALL CONFERENCE ROOM In attendance at this Stewardship meeting were Supervisor Scott Russell, Town Councilman Al Krupski, LPC members - Ray Huntington, Maureen Cullinane, and John Sepenoski, Land Preservation Coordinator Melissa Spiro, and Jim McMahon and Jeff Standish from Dept of Public Works. Supervisor led discussion in regard to items on Jim’s stewardship task list and items on LPC’s task list; group decided which items would be completed and which would not. LPC requested that Town Board provide the Committee with a monthly update progress report for tasks discussed at the April 1, 2010 meeting. ?? UPDATE re: ASSEMBLYMAN THIELE’S CPF STEWARDSHIP TASK FORCE Melissa noted that a Task Force has been set up by Senator LaValle and Assemblyman Fred Thiele in regard to CPF Stewardship. Melissa is on Task Force and will keep LPC informed. ?? STEWARDSHIP PLANS FOR LPC REVIEW: Arshamomaque Pond Preserve; Pipes Cove Properties; Hog’s Neck Properties John Sepenoski led discussion on these Stewardship Plans that were previously sent by him via e- mail to LPC members for comments and suggestions. LPC members’ comments and suggestions were incorporated into the plans. An additional comment was made to add “funding source” to property acquisitions listed in table within each plan, which John will add before sending final draft copy to Town Board for resolution adoption. Ray Huntington handed out information sheet he compiled regarding parcels. General Land Preservation Items: ?? AGRICULTURAL ADVISORY COMMITTEE MARCH 9, 2010 MEMO TO TOWN BOARD WITH RECOMMENDATIONS TO TOWN BOARD HOLD – not discussed due to time constraints. Next Regular Meeting: ?? The next regular meeting will be held on Tuesday, April 27, 2010, at 7:00 p.m., in the Annex Executive Board Room. Adjournment: ??
