Moore, Esq. on behalf of JOHN & EMILY BREESE applied to the Southold Town Trustees for an Amendment to Wetland Permit #7200 under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated January 7, 2013, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, in accordance with Chapter 268, said application was found to be Exempt from the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the structure .complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, • 2 • NOW THEREFORE BE IT RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to Wetland Permit #7200 for the storm damaged part of the dock; replace 6'x9.6' wood dock with 4'x18' wood dock which will enable to use shorter aluminum ramp; replace 28' permitted aluminum ramp with 20'x30" aluminum ramp; add two (2) tie-off piles on east side; relocate existing float, with the condition that all pilings except the ones being relocated are to be removed, and as depicted on the survey prepared by Robert H. We respectfully request an amendment to our permit as follows: • replace the existing 6 x 9.6 wood dock with 4 x 17.6 wood dock. This will strengthen and allow usage of a shorter ramp • instead of the 28' aluminum ramp, install a 20' aluminum ramp. The longer ramp will be quite unwieldy to move, and the impact of Sandy makes it clear that there needs to be a means to disconnect the ramp from the float in the event of a storm. • Add two tie. off piles east of the dock. Northeast storms put considerable strain on docks and vessels in Jockey Creek and thse piles will allow needed support. Please note existing dolphins installed by previous owners will be removed. I am enclosing the revised plans by Sea Level Mapping last dated November 8, 2012 together with photos and copies of letters to the NYS DEC, Army Corps. SCTM#70-6-24 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the denoted following Policy Standards and therefore is INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The proposed dock does not conform to Chapter 275 regulations, more specifically: (c) Regulations for the placement and configuration of docking facilities. (1J Residential docks. (Amended 10-11-2005 by L.L. No. 17-2005] (b] If any part of a residential dock structure includes a float or floating dock, the float or floating dock portion shall be designed so that, with the exception of the pilings: (i] It is no larger than six feet wide and 20 feet long except on Fishers Island if the need is demonstrated; or of equal square footage as determined by the Trustees; (Amended 12-18-2007 by L.L. No. 23-2007] The proaosed float i§ 8' x 24' and does not conform to the above section Additionally, aerial photos indicate that the proposed extension would project sea-ward of the existing dock line and therefore would not conform to the below cited section (Figures 1 and 2).
