Dear Mr. Ham:
The Southold Town Board of Trustees conducted a site inspection on May 5, 2010 and
reviewed the site plan prepared by Richard H. Stmuse dated December 9, 2009 and determined
the proposed additions to the existing firehouse to be out of the Wetland jurisdiction under
Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal
Erosion Hazard Area (Chapter 111 ) no permit is required. Please be advised, however, that no
construction, sedimentation, or disturbance of any kind may take place seaward of the tidal
and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard
area as indicated above, or within 100' landward from the top of the bluff and/or wetlands
jurisdictional boundary, without further authorization from the Southold Town Board of Trustees
pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to
ensure that all necessary best management practices are taken to prevent any sedimentation or
other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands
jurisdiction and Coastal Erosion Hazard Area, which may result from your project.
This determination is not a determination from any other agency.

Re: Letter of Non-Jurisdiction for Fishers Island Fire District
Dear Board Members:
I represent the Fishers Island Fire District which is in the process of applying
to the Zoning Board of Appeals for setback variances that will allow it to add an office and
another fire truck bay to its firehouse at Athol Crescent and Equestrian Avenue on Fishers
Island (SCTM No. 1000-009.00-02.00-004.001). I have enclosed prints of a survey
(Boundary and Topography as Sheet 1 and Proposed Addition as Sheet 2) prepared for
Fishers Island Fire District by CME Associates Engineering, Landscaping & Architecture,
PLLC under date of December 9, 2009.
As you can see from the enclosed survey, while there are wetlands at the
rear of the existing firehouse, the proposed construction is at the front of the property and
more than 100 feet from those wetlands. I would appreciate it if you would visit the site
when you go to Fishers Island next week and, if you can confirm that the project is indeed
out of your jurisdiction, issue a letter of non-jurisdiction and mail the same to me.
will provide specific evidence of my authority to act for the Fire District in
due course if you need more than the copy of the enclosed letter of authorization
addressed to the Zoning Board. In the meantime, please at least visit the site and make
your determination. I have enclosed my firm's check to the Town of Southold for the $50
inspection fee.
