BEGINNING at a point on the southwesterly side of Shipyard Lane,where the same is intersected by the
division line between Lots 2 &3 on the aforesaid map; said point or place of beginning being also distant
North 37 degrees 45'52"West, 165.30 feet as measured along the southwesterly side of Shipyard Lane
from the northwesterly end of a curve having a radius of 40.00 feet a length of 62.83 feet which said curve
connects the southwesterly side of Shipyard Lane with the northwesterly side of Marina Lane;
RUNNING THENCE from said point or place of beginning along the division line between Lots 2 &3 and
along the division line between Lots 2&8 South 52 degrees 14' 08"West, 214.47 feet to the northeasterly
side of land now or formerly of New York State Department of Public Works;
RUNNING THENCE along said last mentioned land, North 33 degrees 35' 38"West, 143.76 feet to the
division line between Lots 1 &2; , ...
RUNNING THENCE along said last mentioned division line, North 52 degrees 14108" East, 204.01 feet to
the southwesterly side of Shipyard Lane;
RUNNING THENCE along the southwesterly side of Shipyard Lane, South 37 degrees 45' 52" East, 143.38
feet to the point or place of BEGINNING.
BEING and intended to be the same premises conveyed to the party of the first part by deed dated
12/30/85 recorded 2/10/86 in Liber 9976 page 456. �"

F TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has riot done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
