BEGINNING at point on the westerly side of Fred Street at the southeast corner of the herein described
premises where the same is intersected by land now or formerly of Peter' Leoniak and Valerie Leoniak;
said point or place of beginning being also distant 100.00 feet northerly as measured along the westerly
side of Fred Street from the corner formed by the intersection of the northerly side of Fisher Road
(Charlie's Lane) (Fanning Road) with the westerly side of Fred Street;
Running thence from said point or place of beginning along land now or formerly of Peter Leoniak and
Valerie Leoniak, North 73 degrees 45 minutes 50 seconds West 151.33 feet to land now or formerly of
Susan E. Fisher;
Thence along said last mentioned land, North 08 degrees 38 minutes 30 seconds East 61.54 feet to land
now or formerly of Alfred Strazza and Marilyn Strazza;
Thence along said last mentioned land, North 21 degrees 48 minutes 00 seconds East, 75.00 feet to land
now or formerly of Charles Brockner and Margaret E. Brockner;

BEING AND INTENDEDTO BE the same premises conveyed to the party of the first part by deed dated
5/13/05, recorded 6/16/05 in Liber 12392 page 881, the grantor herein being the same as the grantee in
deed recorded in Llber 12392 page 881.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.
