EXECUTOR'S DEED

WALTER R. MILLER, JR., as Executor of the Estate of June Ann Miller, presently
residing at 37 Dunlop Road, Huntington, New York, with respect to a twenty-five
(25%) percent interest in the below-described premises,
deceased,
party of the first part,
and WALTER R. MILLER, JR., presently residing at 37 Dunlop Road, Huntington, New York,
party of the second part,
WlTNESSETH, that:the party of the first part, by virtue of the power and authority given in and by said Last Will and
Testament, and in consideration ofTEN ($10.00) DOLLARS, paid by the party of the second part, does hereby grant
and release unto the party of the second pan'y, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, situate, lying and being at Horton's Point in the Town
of Southold, Suffolk County, State of New York, bounded and described as follows:
BEGINNING at a granite monument set on the southerly line of land conveyed to Gerard E. Neyroud
by deed dated June 8, 1946 and recorded in the Office of the Clerk of Suffolk County June 12, 1946
in Deed Liber 2576 cp576, said granite monument being about 630 feet northeast along said line
from the northeast line of Horton Lane; running thence along said southerly line south 51 degrees
59 minutes 50 sec6nds west 145.05 feet to other land of Gerard E. Neyroud; thence along said other
land of Gerard E. Neyroud north 64 degrees 50 minutes west 702.97 feet to the ordinary high water
mark of Long Isla,hd Sound; thence along said ordinary highwater mark of Long Island South north
36 degrees 53 minutes 30 seconds east 216.07 feet to land of Juell M. Bie; thence along said land
ofJuell M. Bie sot~lh 64 degrees 50 minutes east 473.58 feet to a monument at the northwesterly line
of a 20 foot right o,fway; thence across said 20 foot right of way and along other land ofJuell M. Bie
south 64 degrees 50 minutes each 250.85 feet to a monument and land of Charles Offenheiser thence
along said land of, Charles Offenheiser south 25 degrees 10 minutes west 82.14 feet to the point of
BEGINNING.

TOGETHER with a right of way 20 feet in width, the northerly line of which begins at the end of
that course described in the above description as running south 65 degrees 50 minutes east 473.68
feet and thence running northeasterly, then southeasterly to the southeasterly line of land of Walter
E. Hyatt. ,.
ALSO a right of ¢~ay over the existing roadway from said southeasterly line of land of Walter E.
Hyatt to Sound Avenue.
ALSO a right ofw'ay 20 feet in width beginning at or near the foot of the bluffs on the southwesterly
line of the premises herein described and running thence southwesterly, then southeasterly, thence
southerly, thence ~outheasterly and thence southerly to Norton's Lane.
BEING AND INTENDED TO BE the same premises transferred to the party of the first part by Deed
dated November 17, 1995 and recorded in the office of the Suffolk County Clerk on January 10,
1996 at Liber 11757, Page 695.
SAID premises be,.ing known as and by street number 2398 Hyatt Road, Southold, New York.
TOGETHER with ali fight, title and interest, if any, of the party of the first part of, in and to any streets and roads
abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances, and also all the
estate which the said decedent had at the time ofdecedent's death in said premises, and also the estate therein, which the
party of the first part has or has power to convey or dispose of, whether individually, or by virtue of said will or
otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, their heirs or
successors and assigns of the party of the second part forever.
AND the party ofthe?rst part covenants that the party of the first part has not done or suffered anything whereby the
said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the 'first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part
will receive the consideration for this conveyance and will hold the fight to receive such consideration as a trust fund
to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of
the cost of the improx~ement before using any part of the total of the same for any other purpose.
The word "party" shrill be construed as if it read "parties" whenever the sense of this indentures so requires.
