THIS INDENTURE made the 20th day of August, nineteen hundred
ninety-eight
BETWEEN Steven Kopack and Elsie Kopack, his wife,
whose address is 246 Mt . Prospect Avenue, Clifton, NJ 07012 ,
party of the first part, and
The Steven Kopack Revocable Living Trust, 50%, and
The Elsie D. Kopack Revocable Living Trust, 50%,
whose address is 246 Mt . Prospect Avenue, Clifton, NJ 07012 ,
party of the second part ,
WITNESSETH, that the party of the first part, in consideration of
ten dollars and other valuable consideration paid by the party of
the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party
of the second part forever,
ALL that certain plot, piece or parcel of land, with the
buildings and improvements thereon erected, situate, lying and
being at Orient, in the Town of Southold, County of Suffolk and
State of New York, known and designated as Plot #3 on Map of
Section One, Orient-By-The-Sea, at Orient, Town of Southold,
Suffolk County, New York, by Otto W. Van Tuyl & Sons, Licensed
Land Surveyors, Greenport, New York, filed in the Office of the
County Clerk of Suffolk, New York on November 21, 1957 , File
#2777, ABS #2997 .
TOGETHER with a right of way over Sound View Road, Three Waters
Lane and over proposed highways to and from Main Road.
Said premises are sold subject to :
1 . Any state of facts an accurate survey may show provided same
do not render the title unmarketable .
2 . Zoning regulations and ordinances of the Town of Southold.
3 . Declaration of Covenants and Restrictions dated November 21,
1957, filed in the County Clerk' s Office of Suffolk County in
Liber No. 4406, Page No. :L54 , filed December 19, 1957 .
Being the same lands and premises conveyed to the party of the
first part herein by Deed of WALTER UHL, INC. , a domestic
corporation, dated July 15, 1961 which was recorded in the
Suffolk County Clerk ' s Office on July 19 , 1961 in Liber No. 5019,
Page No. 81 .
TOGETHER with the appurtenances and all the estate and rights of
the party of the first past in and to said premises; TO HAVE AND
TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the
second part forever.
AND the party of the first part covenants that the party of the
first part has not done or suffered anything whereby the said
premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of
the Lien Law, covenants that the party of the first part will
receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied
first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for
any other purpose .
