party of the first part,
CHARLES HEMBURY and MARY HEMBURY, husband and wife, both residing at 52 Sheppard
Lane, Smithtown, New York, 11787
party of the second part,
WITNESSETH, that the party of the first part, in consideration of TEN ($10.00) dollars,
lawful money of the United States paid by the party of the second part, does hereby grant and release unto
the party of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being in the
SEE SCHEDULE "A"ANNEXED HERETO
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said
premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the frrpt part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party"shall be construed as if it read "parties" whenever the
sense of this indenture so requires.

SCHEDULE "A"
ALL khat certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being at East Marion, Town of Southold, County of Suffolk and State of New York, shown as lot
nos. 154 and 155 and a part of lot no. 153 on a certain map entitled "Map of Section Two, Gardiner's Bay
Estates", which map was filed in Suffolk County Clerk's Office on September 23, 1927, under the number
275; said lots and part of lot when taken together being more particularly bounded and described as follows:
BEGINNING at a point on the northwesterly side of Beach Court (Private) at the southerly end of a curve,
the tie line of which bears south 28 degrees 07 minutes 20 seconds east and has a length of 39.02 fit, said
curve connects the southwesterly side of Pine Place (Private) and the northwesterly side of Beach Court-illi ?' .
RUNNING THENCE from said point or place of beginning, south 36 degrees 32 minutes 30 seconds west
115.0 feet along the northwesterly side of Beach Court to the division line between lots 155 and 156;
RUNNING THENCE north 42 degrees 48 minutes 30 seconds west 157.38 feet;
THENCE north 36 degrees 32 minutes 30 seconds east 49.96 feet to the southwesterly side of Pine Place;
RUNNING THENCE along the southwesterly side of Pine Place the following 2 courses and distances:
1. South 82 degrees 16 minutes 40 seconds east 34.23 feet;
2. Along the arc of a curve bearing to the right, the tie line of which bears south 75 degrees 28 minutes
east and has a length of 96:45 feet to the northwesterly end of the curve first above mentioned.
RUNNING THENCE in a southeasterly direction along,the arc of said curve bearing to the right to the
northwesterly side of Beach Court, the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated
September 30, 1996 recorded in the Office of the Clerk of the County of Suffolk on October 24, 1996 in
Liber 11 798 page 751.
