SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated December 15, 2009 stating that this application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
LWRP: This application has been reviewed under Chapter 268, Waterfront Consistency review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the
information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the
records available to us, it is our recommendation that the proposed action is EXEMPT from LWRP coastal
consistency review requirements pursuant to Section 268-3.
PROPERTY FACTS/DESCRIPTION: This 11,105 square foot non-conforming parcel is improved with a one
story cottage style home fronting 89.47 feet on Peconic Bay, with 122 feet along Third Street, 90 feet along the
northern property line and 127 feet on the easterly property line.
BASIS OF APPLICATION: Request for variance from Code Section 280-15, based on an application for building
permit and the Building Inspector's September 23, 2009 Notice of Disapproval concerning as-built accessory shed,
1) at less than the code required 35 foot front yard setback, 2) location of accessory shed in the side yard rather
than a rear or front yard, (adjacent to Great Peconic Bay) at 20 Third Street New Suffolk, NY. CTM#: 11%10-19.
RELIEF REQUESTED: The applicant requests relief from the following: Section 280-15, on waterfront lots
accessory buildings may be located in the front yard, provided that such buildings meet the front yard principal
setback. The present plan shows the existing shed at 30', code requires 35'. The present location of the shed is in
the side yard, where a rear or front yard is required per code.
ADDITIONAL INFORMATION: The applicant submitted a plan to the Building Department on location of
proposed shed, which was submitted with this application. The survey by Nathan Taft Corwin, III Land Surveyor,
dated November 19, 2009 update survey, indicates an "as-built" shed in its present non-conforming location.

FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearings on this application on March 25, 2010, at which time written
and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property,
and other evidence, the Zoning Board finds the following facts to be tree and relevant and makes the following
findings:
On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following
findings:
Town Law §267-b(3)(b~(l) Grant of the variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The "as built" shed is located in the rear of the existing offstmet
parking area for the home. Present survey indicates a setback of 31.9' from the front property line. The parcel is
located in an older non-conforming community, where lot sizes are from one quarter of an acre to three quarters of
an acm in square footage. Most of this entire area of New Suffolk, was built out, prior to the establishment of the
Zoning Code in the Town of Southold. The placement of this "as built" shed, although placed in the side yard area,
will not cause a detriment to adjacent properties. The surrounding parcels, share the similar non-conformities, as
the improvements on the subject property.
Town Law ~267-b(3)(b)l'2) The benefit sought by the applicant can be achieved by some method, feasible for the
applicant to pursue, other than an area variance. The applicant could move this shed to the rear yard area, however,
this location allows for easy access to the shed, adjacent to the parking area. Also, the applicant chose this location
to allow his adjoining neighbors clear view of the bay. The shed is in line with the easterly side of the home, which
places the shed in the technical side yard.
Town Law §267-b(3~(b~(3~ The variance granted herein is not substantial, the variance requested is a 9% relief
from the code required 35 foot front yard setback.
Town Law §267-b(3){b}(4) No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
terrain is flat and there are no drainage problems on site. The shed is landward of the existing dwelling and has no
impact on the Bay
Town Law §267-b{3)(b){5) The alleged difficulty has been self created, by building the shed in its present
location.
Town Law .~267-b. Grant of alternative relief, is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of easy access to his shed, while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Weisman
(Chairperson), and duly carried, to
GRANT, the variance as applied for, and shown on the survey, dated January 2, 2008, updated November
19, 2009 by Nathan Taft Corwin, III, Land Surveyor.
Subject to he following conditions: 1. The shed shall contain the only utility of electricity.
2. The shed shall only be utilized for storage purposes.
That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued.

Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays
and/or a possible denial by the Building Department ora building permit, and may require a new application and
public hearing before the Zoning Board of Appeals. This action does not authorize or condone any current or
future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase
the degree of nonconformity.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy

Reasons for Appeal
Area Variance Reasons:
1) And undesirable change will not be produced in the CHARACTER of the
neighborhood or a detriment to the nearby properties if granted, because:
BOARD OF APPEALS
The positioning of the shed was determined after much consideration to both the
aesthetics and character of the neighborhood Its size and design blend with the
surrounding property and house. It was left unpainted, to weather to a natural grey
color, in keeping with the style of many houses and sheds in the surrounding area. Its
location, close to the beach stone parking area, the house and the street, is intended to
facilitate its use for storage purposes, as well as to reduce its impact on the scenic
viewshed of the surrounding neighbors.
2) The benefit sought by the applicant CANNOT be achieved by some method
feasible for the applicant to pursue, other than an area variance, because:
The purpose of the shed is to store bicycles, kayaks, other sporting equipment, and
household and gardening tools in an architecturally compatible structure rather than
leaving the items outside or in outdoor plastic storage containers. Therefore, its
proximity to the driveway, car, and house is crucial, as it minimizes traffic through the
yard and plantings by facilitating easy loading and unloading. To move it further back
(closer to our neighbors, and directly in front of one neighbor's water view), would not
only upset them in terms of aesthetics, but would mean potentially disturbing them with
the noise and traffic associated with everyday shed use. The subject property lacks a
garage or other means of storage.
3) The amount of relief requested is not substantial because:
Article III, Section 280-15 states that "on waterfront lots accessory buildings may be
located in the front yard, provided that such buildings meet the front yard principal
setback." The required setback is 35' whereas the existing shed is at 3[}q ~) The
requested relief of ~ ~ 3~ feet is not substantial because the property is pre-existing, non-
conforming, as is the dwelling, in terms of its location on the property. Conformance
with the Zoning Code wouM require placement of the shed directly within the viewshed of
the residence to the direct north, as well as result in the sitting of a shed close to the
property lines of other pre-existing, non-conforming lots and their pre-existing, non-
conforming residences (as regards some yard setbacks). The requested relief would
preserve sightlines to the water of surrounding residences, as well as preserve the overall
sense of open space within the subject lot.
4) The variance will NOT have an adverse effect or impact on the physical or
environmental conditions in the neighborhood district because:
By keeping the shed closer to the house, we are attempting to consolidate structures and
activity close to the street. Granting this variance will minimize sprawl across the
property, thus enabling both pre-existing and new plants, trees, and shrubs to remain
where they are and continue to flourish. It will help keep the yard plan open, and the
water views from the North and East will remain intact for our neighbors. Finally, there
are no neighbors to the West, so there will be no visual intrusion there.
5) Has the alleged difficulty been self-created?
No. The property is a pre-existing, non-conforming waterfront lot with a pre-existing,
non-conforming dwelling.

INSTRUCTIONS
a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

Dear Members of the Zoning Board of Appeals.
I am writing with respect to item #6354 on the March 25th 2010 meeting agenda, a request for a
variance by Mr. Nicolas deCroisset with respect to the set back of an as-built accessory shed on his
property CTM#117-10-19 which is directly across third street from my property in New Suffolk.
Mr. deCroisset has proven to be an excellent neighbor and has made improvements to his property
which are consistent in scale and reflect well on the neighborhood. The positioning of the auxiliary
shed, which is entirely consistent with the style and scale of other nearby structures, was placed three
feet closer to the front property line than permitted. I know this to be an inadvertent error.
Furthermore, it is my strong opinion that moving this structure three feet further back would have no
material effect on the appearance of the structure on the property or its effect on the adjoining
properties or the view from my property.
