THIS INDENTURE, made the 144h dray of July, nineteen hundred and ninety-nine
BETWEEN
JAMES O'NEILL, residing at 1201 River Reach Drive, Apt. 415, Fort Lauderdale, Florida
33315, as beneficiary of the Estate of M. Gabrielle O'Neill
party of the first part, and
MICHAEL D. MIGGINS and KATHLEEN A. MIGGINS, husband and wife, both residing at
9352 Braymore Circle, Fairfax, Virginia 22039
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever, an
undivided one-half interest in and to
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected,
situate, lying and being at East Marion, Town of Southold, County of Suffolk and State of
New York, and being more particularly bounded and described as follows:-
BEGINNING at the point of intersection of the northwesterly line of SouthLane with the
southwesterly line of East Lane, and
RUNNING THENCE southwesterly along said line of South Lane, 92.875 feet to land now or
formerly of Edna G. Smith;
RUNNING THENCE northwesterly parallel with the southwesterly line of East Lane and
along said land of Edna G. Smith, 100 feet;
THENCE northeasterly parallel with South Lane, 92.875 feet to the southwesterly side of East
Lane, and 1
THENCE southeast along said line of East Lane, 100 feet to the point of BEGINNING.
TOGETHER WITH easements, right of way and subject to covenants and restrictions set forth
in the deed recorded in Liber 4378 page 402.

BEING AND INTENDED TO BE the same premises conveyed to M. Gabrielle O'Neill by
deed dated December 11, 1978, and recorded in the Suffolk County Clerk's Office on
December 29, 1978 in Liber 8560 page 509.
TOGETHER WITH an easement to pass and repass over South Lane, East Lane, West Lane,
and North Lane out over Sylvan Drive and' Old Orchard Lane to the Main Road for the
purpose of access to said premises from said highway.
TOGETHER WITH the right to use the beach along Gardiner's Bay for bathing and similar
purposes with an easement for a right of way over the path leading from South Lane to said
beach, such use to be subject to such reasonable restrictions as may be imposed and to be in
common with other persons to whom similar rights may be granted.
This deed does hereby create a joint tenancy with the right of survivorship between the party of
the first part and the parties of the second part.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof, TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to.be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year
first above written.
