(631) 765-1809 Fax 765-9064 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PR(:;PERTY FACTS/DESCRIPTION: The applicant's 4,522 sq. ft. parcel is ~mproved with a two- stQ;y, one-family dwelling with garage. The northeast comer of the dwelling is 9.3 feet from the e~gsterly front property line along Village Lane and 11.1 feet at the opposite corner. The remaining yard setbacks are 14.7 feet from the north side property line, 16.1 feet at the south side, and 22.4 feet from the rear property line, at its closest points, as shown on the March 22, 2002 survey prepared by Joseph A. Ingegno, L.S., revised September 16, 2003. Based on the 2003 survey map, the existing lot coverage calculation is noted by the applicant to be 21.25%, or 961 sq. ft. BASIS OF APPLICATION: Building Department's August 14, 2003, December 3, 2003, and December 18, 2003 Notices of Disapproval, citing Sections 100-242A and 100-244, in its denial of a building permit application for new additions and alterations, proposed at less than 35 feet from the rear lot line and exceeding the 20% lot coverage limitation. In the final Notice of Disapproval dated December 18, 2003, the Building Inspector removed the reason for disapproving new construction within 25 feet on a side yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on December 18, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct a new overhead door, proposed second-story bay window, proposed 21' x 8' ground level wood deck in the same footprint of the existing concrete patio with existing 16'7" upper level deck and 4' wide steps, and proposed exterior staircase/landings with guard wails, as shown on the survey prepared by Joseph A. Ingegno, L.S., revised September 18, 2003, and diagram prepared by Hideaki Ariizumi, R.A. dated 7/6/03. The proposed setbacks shown on the September 18, 2003 survey are (a) 22.4' to the rear property and (b) 10' to the southerly side property line, at its closest points. Page 2 - January 8, 2004 Appl. No. 5436 - John Henry 26-1-15.1 at Orient ADDITIONAL INFORMATION: During the December 18, 2003 public hearing, the applicant and architect furnished a new chart with variables in lot sizes, lot coverages, setbacks, and new calculations for his property, based on different surveyor maps issued in 1999, 2002, and 2003. The applicant bases his variance requests on the most recent survey, revised September 18, 2003, prepared by Joseph A. Ingegno, L.S. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: '~ 1. Grant of the relief requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The existing setback is +-22.4' to the rear property line, which will be maintained with the new deck construction. The new cedar deck construction will replace an existing concrete patio, and will be underneath an existing second-story deck. The southerly addition is for an exterior open staircase, on an angle, providing access to the second floor. The owner/applicant of this lot also owns the house on the adjacent lot to the south. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The setback of the house is nonconforming at 22.4' to the rear line, and with respect to the staircase, there is no alternative access to the second floor, and the additional building area increases the lot coverage. 3. The variances granted herein are not substantial. There is an upper level deck existing, and the proposed ground level deck does not increase the footprint of the building. The staircase is necessary for access to the second floor. 4. The difficulty was self-created when the new construction was planned without conforming to the current Town Code requirements. 5. No evidence has been submitted to suggest that a variance in this residential community with smaller, improved waterfront lots, will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant has also requested and obtained written authorization from the Town Trustees under the Town Wetland Ordinance dated on or about April 29, 2002. 6. Grant of the relief requested is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by Chairwoman Oliva, and duly carried, to GRANT the variance as applied for, as shown on the survey prepared by Joseph A. Ingegno, L.S., revised September 16, 2003 and diagram prepared by Hideaki Ariizumi, R.A. dated 7/6/03.
