THIS INDENTURE, made the �y day of July, nineteen hundred and ninety-nine BETWEEN JAMES O'NEILL, residing at 1201 River Reach Drive, Apt. 415, Fort Lauderdale, Florida 33315 party of the first part, and MICHAEL D. MIGGINS and KATHLEEN A. MIGGINS, husband and wife, both residing at 9352 Braymore Circle, Fairfax, Virginia 22039 party of the second part, WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, an undivided one-half interest in and to ALL THAT CERTAIN plot., piece or parcel of land, with the buildings thereon erected, situate, lying and being at East Marion, Town of Southold, County of Suffolk and State of New York, and being more particularly bounded and described as follows:- BEGINNING at an iron pipee on the southwesterly line of a 30 foot private road known as "East Lane" 100.0 feet northwesterly along said southwesterly line from a 30 foot private road known as "South Lane", said point of beginning being the northerly corner of land of Daly; and from said point of beginning RUNNING THENCE along said land of Daly and along land of Smith, South 42 degrees 46 minutes 30 seconds West, 135.38 feet; THENCE along other land of O'Neill and along land of Mullane, North 31 degrees Ol minutes 30 seconds West, 126.77 feet; THENCE along said other land of O'Neill, North 58 degrees 58 minutes 30 seconds East, 1:30.0 feet to said southwesterly line of "East Lane"; THENCE along said southwesterly line, South 31 degrees Ol minutes 30 seconds East, 89.0 feet to the point of BEGINNING. DISTRICT SECTION BLOCK LOT BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated March 27, 1991, and recorded in the Suffolk County Clerk's Office in Liber 11240 page 474. TOGETHER WITH an easement to pass Land repass over South Lane, East Lane, West Lane, and North Lane out over Sylvan Drive and Old Orchard Lane to the Main Road for the purpose of access to said premises from said highway. TOGETHER WITH the right to use the beach along Gardiner's Bay for bathing and similar purposes with an easement for a right of way over the path leading from South Lane to said beach, such use to be subject to such reasonable restrictions as may be imposed and to be in common with other persons to whom similar rights may be granted. This deed does hereby create a joint tenancy with the right of survivorship between the party of the first part and the parties of the second part. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof, TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
