Taylor Testamentary Trust Under Will Doted Januury 22, 1993 pa~y of the second part, WITNESSETH, that the party of the first 1~, by virtue ofthe power and authority given in and by said last will and testament and in consideration ofTEN and no/100ths (510.00) dollars, paid by the pm'ty of the second pan, does hereby grant and release unto the patty of the second part. the heirs or successors and assigns of the pony ofthe second pan forever, ALL THAT CERTAIN PLOT, piece or parcel of land, with the buildings and improvements the~on erected, situate, lying and being on Peconic Bay, at Cutchogue, in the Town of Southold, Count)' of Suffolk and State of New York, 'and known and described on a certain map of Baachwood Colony I'roparty, made by Franklin F. Overton, Surveyor, September 1916, tiled in the Office of the Clerk ofthe County of Suffolk on the 14th day of February, 1917, as and by lot number five (5). bounded and described as foilings: BEGINNING at a point on the Great Peconic Bay, at a certain iron pipe monument, distant one hundred sixty (I 60) feet easterly of land now or formerly of Mrs. O.B. Goldsmith: RLfI~INCi northerly a d~slunce of three hundred forty-six (346) feet along the easterly boundary of Lot No. 4 and running thence along the lands now or formerly of Henry V. Downs North 74 degrees 42 minutes East a distance of forty (.40) feet to n certain other iron pipe monument: RUNNING THENCE southerly a distance of three hundred forty, five (345) feet to a certain other iron pipe monument on Great Pceonic Bay; and THENCE westerly along Great Peconic Bay. a distance of forty (40) feet to the point or place of BEGINNING. TOGETHER with a right of way l'or ingress and egress over and through the lots lying west ofsaid premises and thence over nnd through land now or ~rmerly of James E. Dean to New Suffolk Avenue, and TOGETHER with a simiizr right of way over and through the lots and lands lying east of said premises and thence over nnd through land now or formerly of James E. Dean to New Suffolk Avenue. BEING AND INTENDED TO be the same premises conveyed to Harry P. Taylor, now deceased, by deed dated September 28, 1957 recorded in the Office of the Clerk of the County of Suffolk on October 7, 19~7 in Liber 4372 page 362. TOGETHER with all right, title and interest, if any, of the party ofthe first part in and to any streets and roads abutting the above described premises to thc center lines thereof; TOGETHER with the appurtenances, and also all the estate which the said decedent had at the time bfthe decedent's death in said premises, ~ also the estate therein, which thc party ofthe first part has or has pox,~r to convey or dispose of.. whether mdividuel, or nthenvise; TO HAVE AND TO HOLD the premises herein granted unto the pat~y of the second part, the heirs or su~:essors and ns.signs ol'the party of the second pa~ forever. AND the party of the first part covenants ihat the party of the first pa~ has not done or suffered anythin~ whereby the said premises have been incumbered in any way whatever, except as aforesaid. AND THE party ofthe first part. in compliance with Section 13 ofthe Lien Law, covenants that the party of 'the first part will ~'ceive the consideration for this conveyance and will hold the right to receive such consideration as a trust f~md to be appUed first for the purpose of paying the cost o£the improvement, and will apply the same first to the payment of the cost ol'the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it rend "parties" whenever the sense of this indenture so requires.
