MAHAFFY, whose post office address is 9 Haig Place, Apt. 211, Dunedin, Florida 34698, party of the first part, AND REID A. MAHAFFY, as general partner of MAHAFFY FAMILY PARTNERS, L.P., a limited partnership organized and existing under the laws of the State of Delaware, having a post office address of 9 Haig Place, Apt. 211, Dunedin, Florida 34698, party of the second part, WITNESSETH, that the party of the first part, in consideration of ZERO DOLLARS ($0.00) paid by the party of the second part, does hereby grant and release unto the party of the second part, the licirs or successors and assigns of the party of the second part forever, ALL THAT CERTAIN plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at Orient, Town of Southold, County of Suffolk, and State of New York, bounded and described as follows: BEGINNING at the monument located at the point of intersection of the southeasterly corner of land conveyed by Joseph H. Stern to Richard A. Stark by deed recorded in Liber 6482 at page 297 and the northerly line of land of Harold W. Conroy as conveyed by the aforesaid Joseph H. Stern by deed recorded in Liber 6410 at Page 597; THENCE along said line of Stark North 40 degrees 25 minutes 30 seconds West 321.82 feet to the ordinary high water mark of Long Island Sound; THENCE Northeasterly along the said ordinary high water mark of Long Island Sound North 40 degrees 30 minutes 30 seconds East 225 feet to land of Jack Stern; THENCE along said land of Jack Stem South 28 degrees 39 minutes 40 seconds East 300 feet to an angle point; THENCE continuing along said land of Jack Stern South 4 degrees 12 minutes 00 seconds West 111.57 feet to the aforesaid land of Conroy; THENCE along said land of Harold W. Conroy South 60 degrees 25 minutes 50 seconds West 84.15 feet to the point or place of BEGINNING. TOGETHER with a Right of Way in common with others for ingress and egress over a strip of land 50 feet in width within and along the southeasterly part of the premises conveyed to Richard .I A. Stark by Liber 6482 cp 297 the southeasterly line of which said 50 foot strip is described as follows: BEGINNING at the monument located at the point of intersection of the southeasterly corner of land conveyed by Joseph H. Stern to Richard A. Stark by deed recorded in Liber 6482 at Page 297 and the northerly line of land of Harold W. Conroy as conveyed by the aforesaid Joseph H. Stern by deed recorded in Liber 6410 at Page 597; and RUNNING THENCE South 60 degrees 25 minutes 50 seconds West 200.00 feet to a monument at the northwesterly comer of land of Harold W. Conroy; AND TOGETHER with a right of way in common with others for ingress and egress over a 50 foot wide right of way, the southwesterly line being bounded and described as follows: BEGINNING at the monument set at the northwesterly corner of land of Harold W. Conroy; RUNNING THENCE South 34 degrees 30 minutes 00 seconds East along the southwesterly line of land of Harold W. Conroy 325.00 feet to a monument; AND TOGETHER with a right of way in common with others for ingress and egress over a 33 foot more or less wide right of way, running southerly from the aforesaid 50 foot right of way , the westerly line of which runs southerly from the southwesterly line of said last described right of way and running along land now or formerly of King for a distance of 745.81 feet more or less to the northerly side of Main-State Road. Being the same property conveyed to the party of the first part by deed from Joseph Hoyt Stern dated September 24, 1969 and recorded October 24, 1969 in the Suffolk County Clerk's Office at Liber 6647 cp 29. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof, TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that,the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. 2 #220791 Q 1 N i AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the First part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
