The subject property is improved with a part two-story mixed use building. The first floor underneath the part second-
story is occupied by the Peconic Post Office and retail space which recently was vacated ( The owner is seeking
another tenant through the efforts of a real estate broker). The second story above this space is curren~_o~_c~upied
by one apartment. The existing apartment is permitted as a legal non-conforming use as per the current
occupancy. The property owners are seeking permission to construct a second apartment.

The above described property was acquired by the owner on May 311 1995 ( Marina Kokkinos to Marina
Kokkinos and Geor.qe kokkinos ) & previously on June 1811987 Marina Kokkinos from Henri/Smith.
B. The applicant alleges that the approval of this exception would be in harmony with
the intent and purpose of said zoning ordinance and that the proposed use conforms to
the standards prescribed therefor in said ordinance and would not be detrimental to
property or persons in the neighborhood for the following reasons:
The current zoning, Hamlet Business, would permit by special exception up to three ( 3 ) apartments on the second
floor. Applicants only seek permission for two (2) apartments. The plans prepared by a licensed amhitect indicate that
the application complies strictly with all the requirements section 100-91 (B) (4) (a), (b), (c), & (d). Subsecaon (e)
requires one on-site parking spot per apartment, which currently exists. Subsection (f) requires the owner to be the
applicant herein, which they are, and they have no objections to the conditions set forth therein. The subject property
adjoins the LIRR dght of way and is in the heart of the hamlet of Peconic. The subject property is exactly the type of
property that the Town Board has identified as a prospective source of affordable and available housing in the Town
of Southold.
C. The property which is the subject of this application is zoned HAMLET BUSINESS and

As stated in my recent conversation with your office, I am the
attorney for George Kokkinos, the current owner of the subject
premises.
The subject certificate of occupancy does not list the retail
store as a legally existing use in conjunction with the other uses
enumerated' on the said certificate of occupancy. It is my understand-
ing that the retail store has existed there since before the turn of
the century. I have personal knowledge that it has existed since the
late 1950's.
Your office has informed me that you are willing to add the
retail store to the list of existing uses set forth on the subject
certificate of occupancy if I can return to your department the origi-
nal certificate with your seal thereon. It is impossible for me to
provide you with same. My client does not have it in his possession.
Edson and Bruer, Esqs., who represented Smith when the property was
sold to my client do not have it. The attorney who previously repre-
sented Smith, Philip O'Frias, is no longer practicing law and does not
live in the area.
My client hereby agrees to be bound by the revised certificate
of occupancy which will include the retail store with the other listed
permitted uses and will make no claim to additional rights based upon
the erroneous certificate of occupancy.

(Zoning), Code of the Town of Southold, the following application will be heard at a public hearing by

Please find enclosed a copy of the Legal Notice describing your recent application. The Notice will
be published in the next issue of the Suffolk Times.
Pursuant to Chapter 58 of the Southold Town Code (copy enclosed), formal notice of your
application and hearing must be now mailed with a map or sketch showing the construction area or
variance being considered. Send the enclosed Notice CERTIFIED MAIL, RETURN RECEIPT
REQUESTED, with the above sketch or survey showing the new construction area, or details of
your request, by Wedneday, June 5th to all owners of land (vacant or improved) surrounding yours,
including land across any street or right-of-way that borders your property. Use the current
addresses shown on the assessment rolls maintained by the Town Assessors' Office (765-1937) or
the County Real Property Office in Riverhead. If you know of another address for a neighbor, you
may want to send the notice to that address as well.
When picking up the sign, a $15 check will be requested for each poster (or metal stand if
needed) as a deposit. Please post the Town's official poster/sign no later than June 13%
Securely place the sign on your property facing the street, no more than 10 feet from the front
property line bordering the street. (If you border more than one street or roadway, an extra sign is
available for the additional front yard.) The sign(s) must remain in place for at least seven (7)
days, and should remain posted through the day of the hearing. If you need a replacement poster
board, please contact us.
By June t7th, please either fax or deliver to our office your Affidavit of Mailin.q (form enclosed)
with parcel numbers noted for each, and return it with the white receipts postmarked by the Post
Office. The original Affidavit is due not later than the date of the hearing. Also, when the green
signature cards are returned to you by the Post Office, please mail or deliver them to us before the
hearing, if possible. If any signature card is not returned, please advise the Board at the hearing.
These will be kept in the permanent record as proof of all Notices.
By June 19th or 20th, and after the signs have been in place for seven (7) days, please submit your
signed Affidavit of Postin.q to our office. A copy may be faxed to us, with the original furnished
during the hearing.
If you do not meet the deadlines stated in this letter, please contact us promptly. Thank you for
your cooperation.
