AUTHORIZATION
Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
November 18, 2009, and in consideration of application fee in the sum of $250.00 paid by Wunneweta Pond
Association and subject to the Terms and Conditions as stated in the Resolution, the Southold Town Board of
Trustees authorizes and perm]ts the following:
Wetland Permit to dredge a 20'x280' area of the inland section of the existing
channel to a depth of-4' below mean Iow water; place the spoil (approximately 108
cubic yards) as beach nourishme~nt in a 16'x180' area previously approved disposal site
located landward of the spring high water mark, with the condition of the deployment
of a silt boom prior to and during all intertidal operations surrounding the immediate
project area, and as depicted on the site plan prepared by Costell0 Marine Contracting
Corp., last dated June 22, 2009, and received on October 27, 2009.
IN WITNESS WHEREOF, the said Board of Trnstees hereby causes its Coq)orate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.

TERMS AND CONDITIONS
The Permittee Wunneweta Pond Association, edo Rich Mayne, residing at 860 Bayberry Road,
Cutchogue, New York as part of the consideration for the issuance of the Permit does
understand and prescribe to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and ail such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach betWeen high and low water marks.
That if future operations of the Town of Southold require:the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Ms. Costello:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, November 18, 2009 regarding the above matter:
WHEREAS, Costello Marine Contracting Corp., on behalf of WUNNEWETA POND
ASSOCIATION applied to the Southold Town Trustees for a permit under the previsions
of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of
Southold, application dated October 27, 2009, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 6.3, 5.3, 6.4 of the Local
Waterfront Revitalization Program to the greatest extent possible through the imposition
of the following Best Management Practice requirements: the deployment of a silt boom
prior to and during all intertidal operations surrounding the immediate project area, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on November 18, 2009, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of WUNNEWETA
POND ASSOCIATION to dredge a 20'x280' area of the inland section of the existing
channel to a depth of -4' below mean Iow water; place the spoil (approximately 108
cubic yards) as beach nourishment in a 16'x180' area previously approved disposal site
located landward of the spdng high water mark, with the condition of the deployment of
a silt boom prior to and dudng all intertidal operations surrounding the immediate project
area, and as depicted on the site plan prepared by Costello Marine Contracting Corp.,

Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

Maintenance Dredge Project
Dear Trustees:
It is my understanding that at the November 18, 2009 public hearing the Board approved the
application to dredge a 20'x280' area of the inland section of the existing channel to a depth of-
4' below mean low water on the condition that proof is made available showing that this area has
been previously dredged. Enclosed you will find a copy of Permit #1559 dated October 6, 1982
issued by the Southold Town Trustees to the Lagoon Association (aka Wunneweta Lagoon
Association) to remove approximately 14,000 cubic yards of spoil. Also, enclosed is the
application and drawing submitted for this approval showing the dredge area.

Costello Marine Contracting Corp. on behalf of WUNNEWETA POND ASSOC. requests a Wetland Permit to
dredge a 20'X 280' area of the inland section of the existing channel to a depth of -4' below mean Iow water.
Place the spoil (approx. 188 cy.) as beach nourishment in a 16'X 180' area previously approved disposal site
located landward of the spring high water mark. Loca[ed: Navigation Channel, Wunneweta Pond.

Note that the plans conflict. The dredge spoil disposal site is referenced on the location map (2 of 10) as
northwest of the inlet. The dredqe spoil site shown on sheet (10 of 10) is located northeast of the inlet. The
location of the disposal site requires clarification.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon
the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as
the records available to us, it is our recommendation that the proposed action is INCONSISTENT with the
following LWRP policy standards and therefore is INCONSISTENT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws
and regulations for all Andros Patent and other lands under their jurisdiction
Comply with Trustee regulations and recommendations as set forth in Trustee permit
conditions.
The proposed action does not comply with the cited section of the Southold Town Code below:
§ 275-11 Construction and operation standards
3) Dredging.
(a) Creeks.

Only maintenance dredging (as defined in § 275-2) is permitted, un/ess the applicant
owns unde~vater land or the applicant is requesting permission to dredge in connection
with installation of Iow-sill bulkheads. All maintenance dredging permits shall be valid for
a period no greater than 10 years. [Amended 12-18-2007 by L.L. No. 23-2007]
Dredging may be permitted when it can be demonstrated that the actions of man have
resulted in impairment to water quality or habitat value.
Dredging in, or in close proximity to salt marsh vegetation (Distich/is spicata, Spartina
altemiflora or Spartina patens) or seagrass (Ruppia maritia or Zostera madna) meadows
is prohibited.
All dredging applications must demonstrate a specific location for the deposit of
dredging material. [Added 12-18-2007 by L.L. No. 23-2007]
§ 275-2. Definitions; word usage
MAINTENANCE DREDGING -- A dredging project will be considered maintenance dredging if there is
documentary evidence that it has been previously dredged.
Wunneweta Pond is owned by the Town of Southold. A search of past permitted actions indicates that the
area proposed to be dred.qed has not been previously dredqed (accordinq to Town records).
In the event that the applicant proves that the proposed action complies with the above regulations the
following best management practices are recommended:
To further policy 5.3; Protect and enhance quality of coastal waters the deployment of a silt boom pursuant to
§ 275-11. Construction and operation standards is recommended.
The proposed disposal site is located within a NYS Audubon Important Bird Area and the TOS/Nature
Conservancy important shorebird nestinq (fi.qure 1. below). To further Policy 6.4 Protect vulnerable fish,
wildlife, and plant species, and rare ecological communities the following restriction is recommended:
1. That all activity associated with the proposed action (dredging) should be avoided during the nesting
and fledgling periods (March 15 through August 15) of shorebirds nesting within the immediate
shoreline to the east and west of Wunneweta Pond inlet.
Further, it is recommended that the contractor be required to meet with representatives of the orqanizations to
discuss the optimum placement and slope of the dredge spoil to minimize impacts to shorebird
habitat/populations.

Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

Foster a pattern of development in the Town of Southold that enhances community
character, preserves open space, makes efficient uso of infrastructure, makes beneficial
uso of a coastal location, and minimizes adverse effects of development.
Our proposal is consistent with this policy in that this channel is used by the members of the
homeowners' association to engage in water dependent activities. The shoaled area is preventing
boaters from entering this section of the pond at iow tide. In order to maintain a safe navigational
channel and maintain the water flow in this section of pond, it is necessary to remove this material.
Policy 2
Presorve historic resources of the Town of Southold.
This project location has no significant historic resources.
Policy 3
Enhance visual quality and protect scenic resources throughout the Town of Southold.
Our proposal will not have any negative impacts on the visual quality or scenic resources. There are
no structural components to our proposal. This proposal is consistent with the area. Areas in
Wunneweta Pond have been dredge recently and there was no impairment to the existing vegetation.
NATURAL COAST POI_~CZES
Policy 4 Hinimize loss of life, structures, and natural resources from flooding and erosion.
This project has will have no flooding or erosion concerns.
Policy 5
Protect and improve water quality and supply in the Town of Southold.
Our proposal will not have any impact of the water quality or supply in the Town of Southold.

Protect and restore the quality and function of the Town of Southold's ecosystem.
Our proposed dredge will maintain the water depth of the existing navigational channel. The dredge
spoil will be placed landward of the spring high water mark as beach nourishment. This will protect
the vegetation located at the spoil site.
Policy 7
Protect and improve air quality in the Town of Southold.
Our proposal will not have any impact on the air quality in the Town of Southold.
Policy 8
Hinimize environmental degradation in the Town of Southold from solid waste and
hazardous substances and wastes.
Our proposal will not influence the environmental degradation in the Town of Southold from solid
waste and hazardous substances and wastes. The dredge spoil is clean transported sand. A large
area of the Pond has been dredged in recent years but this area is experiencing shoaling limiting the
access of the property owners.

Policy 9 Provide for public access to, and recreational use of, coa~,;--I waters, public lands, and
public resources of the Town of Southold.
Our proposal will give the property owners the ability to safely access and navigate Wunneweta
Pond. There will be no change in the ability of the public to access public resources of the Town of
Southold.
WI~RK~N~; COAST POLICIES
Policy 10 Protect the Town of Southold's water-dependent uses and promote siting of new water-
dependent uses in suitable locations.
This is an existing channel leading to Spring Pond where there are a number of waterfront properties.
Maintaining the channel will allow these homeowners to engage in water dependent activities and the
ability to reach larger bodies of water.
Policy 11
Promote sustainable use of living marine resources in the Town of Southold.
The channel is an active waterway and not the most desirable habitat for living marine resources.
The area to be dredged is relatively small in comparison to the entire waterway. This amount of
dredging will have a minimal effect on the madne resources.
Policy 12
Protect agricultural lands in the Town of Southold.
Our proposal will not have any impact on agricultural lands in the Town of Southold.
Policy 13 Promote appropriate use and development of energy and mineral resources.
