Pursuant to the provisions of Chapter 275 and/or Chapter 111 of ~he Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
February 24, 2010 in consideration of application fee in the sum of $250.00 pa!d by Mattituck Fishing Station
subject to the Terms and Conditions as stated in the Resolution,

IN WITNESS WH~OF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee, Mattituck Fishing Station, 2275 Naugles Dr., Mattituck NY, as part of the
consideration for the issuance oftbe Permit does understand and prescribe to the following:
That the said Board of Tmstecs and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involyed will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions oftbe originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable,interference with navi~b, tion as a result of the work
berein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter th!s work project herein stated without
expenses to the Town of Southold.
That the said Board will be notified by the Permittee of the completion 6f the work
authorized.
That the Pennittee will obtain all other permits and consents that may be're~ired
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Mr. Tartaglia:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., February 24, 2010 regarding the above matter:
WHEREAS, High Point Engineering on behalf of MATTITUCK FISHING STATION
applied to the Southold Town Trustees for a permit under the provisions of Chapter 275
of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated January 6, 2010, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, in accordance with Chapter 268, said application was found to be Exempt
from the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on February 24, 2010, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Boar(~ has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees APPROVES the application of MATTITUCK
FISHING STATION to remove (1) 3,000 gallon single wall fiberglass gasoline UST,
install (1) 3,000 gallon double wall steel UL #2085 Fire Rated A.S.T. with new piping
and dispensers along bulkhead, and as depicted on the site plan prepared by High
Point Engineering dated September 14, 2009.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.

Your Application for Permit to Construct a Toxic or Hazardous Material Storage Facilities for the above
referenced site has been reviewed for compliance with Articles 7 & 12 of the Suffolk County Sanitary Code.
The application has been approved. The items listed below and on the back of this Permit are conditions of this
Permit and have to be observed during construction:
A copy of the approved plan must be kept at the construction site. A copy of this permit must be kept
on display at the facility during construction.
Safe construction practices must be followed during the installation of the storage facility(s).
The storage facility(s) must be constructed in accordance with the approved plan. Any changes in
design, materials or use requires prior written consent of both the design professional and the Office
of Pollution Control. The changes have to be submitted in a form that is acceptable to the Office of
Pollution Control. The contractor and/or design professional is required to inform the owner that the
changes are being made.
The Office of Pollution Control has the right to inspect this installation at any time to verify its being
constructed in compliance with this permit.
The Office of Pollution Control must be contacted at 854-2523 at least 2 business days prior to commencement
of any work to arrange for the required consttuction inspections.
Contact the local building department and/or fire safety enforcement office for any additional requirements that
may apply to your project.
The storage facility cannot be placed into service until the Office of Pollution Control performs all
required installation inspections and issues an interim permit to operate.
The Office of Pollution Control reserves the right to revoke this permit as allowable by law.

For up to 90 days aRer the Permit to Construct expires, the permit is renewable. The job file will remain open for
that period. If the Office of Pollution Control does not receive a renewal application with the appropriate fees within

to be re-opened. All applicable filing fees will once again become due and payable.
Issuance of this permit does not supersede any existing agreements with, or mandates by, the
Office of Pollution Control or any other government agency. The construction period does not
supersede any existing compliance dates agreed to, or mandated by, the Office of Pollution Control

Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is EXEMPT from LWRP review pursuant to:

Describe the nature and extent of the environmental impacts reasonably anticipated resulting

The proposed project shall impact the environment in a positive fashion. The proposed
above ground double wall steel gasoline tank with electronic monitoring system
provides increased security against tank leakage into the environment. It also satisfies
SCDHS mandate (effective by 2010) that all fuel storage tanks have secondary
containment whereas the existing underground tank is of single wall construction. In
the unlikely event that the primary tank leaks, the fuel will not be in direct
contact with the soil and groundwater as it will be contained within the secondary
space and it's presence identified by the electronic leak detection probe.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken.

Although the proposed action introduces an above ground fuel storage tank approximately 62 feet away
from the bulkhead, the proposed above ground tank will be approximately 187 feet away from Naugles
Drive and hence will not be visible from the roadway. It's visual impact from the waterway will be
minimized by the buildings in front of/around it as well as the extensive landscaping on-site.
