Whilst we appreciate that this is a renewal of existing permit No 6302,we feel that 3 issues need to clarified, bearing in mind the Fergus property is now on the market for sale and that a future owner may not he so sympathetic to some of the concerns we have. A summary of these follows: 1. Grading and Water Run Off-We still have concerns regarding water run off, adequacy of French drain and dry wells. Our hydrologist advice conflicts with die Fergus calculations.We seek a covenant to be added to die permit to ensure water runoff is contained on the Fergus property, that would make it a slightly less arduous task to bring an enforcement action should that become necessary. 2. Diamond Back Terrapins - Protected wider Environmental Conservation Law 11-0311121,which prohibits willfully taking, destroying or disturbing in any maturer the eggs or nest of a diamondback terrapin in the wild. (see attached DEC Regulation.).This also establishes an Open and Closed Season and a requirement to have a License to take them in the Open Season, and a minimum size at which they can be taken at any time of year. We seek to add a covenant to the Permit which prohibits the excavation and construction taking place during die Closed Season to minimize the impact on this species. The Closed Season is May 1st to July 31st. The Fergus property is a known nesting site for Diamondback Terrapins. (See letter attached). We appreciate your concerns for the environmental quality of this area in general and the neighborhood around North Bayview Road in particular. We also recognize the effort you have made to provide us with your pertinent comments. The Fergus site is sometimes used by Diamondback Terrapin turtles. The Diamondback Terrapin is a protected species in New York State,however, the currently protection is listed as a game species. Game species may be hunted during special seasons with certain restrictions and limitations. Diamond Terrapins are an aquatic species that spend the majority of time directly in marine and brackish waters. They use the immediate beach and shoreline areas for nesting habitat. The Tidal Wetlands permit issued for the Fergus site requires a 50 foot natural buffer area to remain undisturbed along the shoreline. Our wildlife biologists believe this buffer area will provide sufficient nesting habitat and protection to any Diamond Terrapins using this area. In addition, our review of the project revealed that the application met the standards for permit issuance pursuant to the applicable sections of the Tidal Wetland Land Use Regulations (6NYCRR Part 661). We also found that the proposal would not likely result in impacts to Diamondback Terrapins using the area. Because the application met the requirements of the regulations and no impacts were likely to occur the enclosed permit was issued. We are confident that the project, completed correctly, will not adversely impact tidal wetlands, Diamondback Terrapins or other natural resources in the area. In addition,the project design incorporates protective features and the permit contains special conditions that should sufficiently protect against damage to natural resources and wildlife. Therefore,we find that there are insufficient grounds to revoke this permit and it shall remain in effect. Thank you for bringing your concerns to our attention. The purpose of this section is to provide protection for the diamondback terrapin, "Malaclemys terrapin", including all of its subspecies. Protective measures include the establishment of a closed season, requirement for a license to take diamondback terrapin from the wild, establishment of size limits and restrictions on the sale of diamondback terrapin. (b) Open season. Diamondback terrapin may be taken from August 1 to April 30 inclusive. (c) Regulations. (1) The following are prohibited: (i) taking, attempting to take, or assisting in taking diamondback terrapin except during the open season. Possession of a diamondback terrapin on the waters or shores of New York State during the closed season shall be presumptive evidence that the diamondback terrapin was taken during such closed season; (ii)taking,attempting to take, or assisting in taking, of diamondback terrapins without a license; (iii)taking or possessing at any time while on the waters or shores of New York State a diamondback terrapin which has a straight line upper shell length less than 1 of 2 2/24/2010 4:50 f Section 3.!: )iamondback Terrapins-NYS Dept of Environmental Co... nap://www.ueauy.g�•, �� .•. four inches or greater than seven inches; (iv) purchase or sale of diamondback terrapin which has a straight line upper shell length less than four inches or greater than seven inches.As used in this section, "sale"means any delivery or transfer of a live diamondback terrapin or the flesh of a diamondback terrapin whether for a consideration or as a gift.As used in this section, "sale"includes offering for sale or possession with intent to sell; (v) sale of diamondback terrapin from May 5 to July 31 inclusive except that diamondback terrapin legally taken during the open season may be sold throughout the year if they were killed and processed for consumption prior to May 5; (vi)taking diamondback terrapin except by the following methods: (1) dip nets, (2) hand capture, (3) seine nets as authorized by Section 13-0343 of the Environmental Conservation Law, and(4) traps capable of capturing diamondback terrapin alive. Each trap must be marked with a tag bearing the name and address of the licensee and must be checked daily; (vii)willfully taking,destroying or disturbing in any manner the eggs or nest of a diamondback terrapin in the wild; (viii)failing to immediately release at the point of capture diamondback terrapin which are caught accidentally or incidentally,or which are not within the legal size limits; and (ix) liberating diamondback terrapin to the wild, except immediately upon, and only at the point of, capture,without authorization by the department. (d) License. (1)A valid diamondback terrapin license is required to take diamondback terrapin. (2)Application for, and purchase of, a diamondback terrapin license may be made by mail or in person at the NYS Department of Environmental Conservation, SUNY Building 40, Stony Brook, NY 11794.The fee for such license shall be ten dollars and such license shall be in effect from July 1st through the following June 30th. During the hearing I was given the opportunity to speak on behalf of the Lanes and partially stated a few of their concerns regarding drainage issues that may result from the development of the Fergus property. The issues which I addressed included the following: The capacity of the proposed French drain. I specifically spoke about the drain being sized for a 2"rainfall event and how it is potentially undersized based on the fact that the design of the drain did not account for the gravel volume within the drain. I also mentioned that the soil in which the drain was installed is a poorly draining material based on the available soil boring, and thus stormwater runoff that enters the drain will not percolate into the unsaturated zone very rapidly. Since the hearing I have prepared some simple calculations for the drain capacity which I have submitted to you electronically. Construction and maintenance of the proposed French drain. During the hearing I asked whether or not the maintenance of the proposed French drain had ever been considered or discussed. Devices like these are prone to sediments and silts accumulating in them and ultimately reducing their effectiveness and capacities and thus need to be maintained. I believe no formal maintenance plan had been prepared at the time of the hearing. Existing and proposed site soil conditions. The existing soil conditions were indicated to consist of poorly draining materials as evidenced by the soil boring presented on the survey of the Fergus property. Thus, stormwater has the potential to generate more runoff quantities as it will not infiltration into the subsurface very rapidly. I asked what were the intended areas of the site to be covered with. What areas would be naturally vegetated and what areas would be turfed? Each of these along with the surface topography (i.e., slopes ,grades, etc.) will effect the value or selection of a design runoff coefficient. The ca•acit of the •ro•osed roof drains for the Fer•us •ro•ert . The design calculations that were provided indicated that a total of three(3)8 foot diameter by 6 foot deep leaching pools would be required for a 2 in rainfall event based on the foot print of the house, garage and decks. This appeared to be adequate, however the proposed basement sump pumps are shown to also be discharging to two of the three pools on the site survey. Is there enough capacity to handle both should the need ever arise? Construction of the roof drains for adequate leaching capacity. The sanitary system is shown being constructed with sand drains or collars installed beneath the leaching pools down to suitable draining materials. This is typically done to help ensure that the pools will drain sufficiently enough by hydraulically connecting them through the poorly draining material with a clean porous material to the suitable material. Is the same going to be done for the roof drain dry wells? No construction details were provided for review. Depth to groundwater information and flow direction. The available test hole data presented on the Fergus site survey indicates a depth to groundwater of 5.5 feet or an elevation of 2.8 feet above mean sea level. The test hole data is from 1989. Is this the historical high groundwater level? Have groundwater conditions at the site changed within the last 18 years? Is the groundwater flow direction known? As the soil data supports poorly draining materials groundwater information will be necessary for positioning and locating drainage structures. Tidal data. As the site is located in a low lying area that is bordered by Goose Creek and Southold Bay, are tidal influences on groundwater levels a factor? Have the high-high and low-low water level elevations been identified? Existing and proposed site topography. At the time of the hearing Mr. Anderson provided a survey of the Fergus property with proposed contours around the proposed residence. Though the drawing is of small scale and could be clearer, it still suffices to be able to work with for preliminary drainage analysis. This was the last issue which I attempted to address but did not fully vocalize. The issue which I wanted to bring up was the amount of cut and fill taking place on the Fergus property. The Board of Trustees Application indicated that a volume of 7,106.67 cubic yards were going to be excavated at the site. If the house footprint is on the order of 5,000 square feet and the basement is installed to a depth of 8 feet, that is a total soil volume of 1,481.48 cubic yards. The area will obviously need to be over excavated to install the concrete forms, etc to construct the basement. Even if a 100% over excavation is applied the volume of soil is still less than 3,000 cubic yards. Where is all the excavation taking place? Is this 7,106.67 cubic yard volume to account for the sanitary system, French drain and roof drains? What is going to be done with the excavated soils that are not going to be re-used? Are they going to be disposed of off-site? Or are they going to be left on site and effect the grading? One last issue which was brought up by the Town attorney is that the Town is in the process of enacting drainage regulations. A copy of the final or draft code should be obtained and reviewed. Again, these were the issues which I brought before the ZBA on March 29 ,2007. I am attaching a copy of the calculations which I performed subsequent to the hearing for your files.
