WltEREAS, DECLARANTS are the owner of certain real property located on
4295 Bay Shore Road, Greenport, Town of Southold, County of Suffolk, State of New
York, described in the Suffolk County Tax Map as District 1000, Section 053.00, Block
06.00, Lot 024.000 which is more particularly bounded and described as set forth in
Schedule "A" annexed hereto, hereinafter referred to as the Property;
WI:IERE~, the property is situated on lands within the jurisdiction of the Board
of Trustees of the Town of Southold 0aereina~er the "Trustees") pursuant to Chapter 275
of the Town Code of the Town of Southold or its successor, and various activities
conducted upon the property may thus be subject to the regulation and approval of the
Trustees prior to being conducted;
'WHEREAS, the DECLARANTS therefore made application to the Trustees for a
permit pursuant to the Wetlands Law of the Town of Southold to undertake certain
regulated activities; and
V~-i'g, REAS, as a condition of the granting ora Wetlands Permit to undertake
such regulated activities, the Trustee required that the landowner demolish the existing
one-story (966 sq. ff.) with the existing foundation to remain; add three (3) courses of
concrete block to the existing foundation to comply to FEMA flood regulations; construct
a new 1 ½ story dwelling on the existing foundation/footprint including a second story
loft/storage containing 580 sq.ft.+/-; construct an addition to the landward side of the
existing foundation/footprint containing 627 sq.ft.+/-; remove the existing sanitary
system and replace with an updated sanitary system within the fxont yard, install a
retaining wall surrounding the sanitary system measuring 118'+/-X1.3'+/-high, install a
French drain along the southern side yard property boundary and establish a 5' wide non-
tuff buffer along the landward side of the bulkhead, with the condition of a previous
driveway, which is not to encroach into the Town Right-of-Way, and a line of staked hay
bales and silt fencing is installed prior to construction activities and maintained
throughout construction, and as depicted on the survey prepared by John T. Metzger
received on January 26, 2010 and stamped approved on February 24, 2010, and plans
prepared by Frank Notaro, Architect received on Januasy 26, 2010 and stamped approved
on February 24, 2010.
NOW, THEREFORE, the DECLARANTS do hereby covenant and agree as
follows:
1) Upon the substantial completion of the aforementioned permitted activities
the, re shall be established and subsequently maintained a 5' wide non-turf buffer along
the landward side of the bulkhead, as defined by Chapter 275 of the Town Code, with the
condition of a previous driveway, which is not to encroach into the Tom-Right-of-Way;
and
2) These covenants shall nm with the land and shall be binding on the
DECLARANTS, his heirs, assigns, purchasers, or successors in interest and may only be
modified after a public heating and upofi resolution of the Trustee.

Dear Mr. Notaro:
The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wed., March 21, 2012:
WHEREAS, Frank Notaro on behalf of ROBERT SWING applied to the Southold Town
Trustees for an Amendment to Wetland Permit #6978 under the provisions of Chapter
275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated February 23, 2012, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the Local Waterfront Revitalization Program policy standards,
specifically with Policies 6 - Protect and restore the quality and function of the Town of
Southold ecosystem and Policy 6.3 - Protect and restore tidal and freshwater wetlands,
and,
WHEREAS, the Board of Trustees has furthered Policies 6 and 6.3 of the Local
Waterfront Revitalization Program to the greatest extent practical through the imposition
of the following Best Management Practice requirements: installation of gutters, leaders
and drywells in accordance with Chapter 236-Stormwater Management of the Town
Code and removal of the portion of patio from within the 5' wide non-disturbance buffer,
and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code, and,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirements imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
BE IT FURTHER,
RESOLVED, that the Southold Town Board of Trustees APPROVES the Amendment to
Wetland Permit #6978 to include the existing on grade patio and to remove the portion
within the 5' wide non-disturbance buffer, and as depicted on the survey prepared by
John T. Metzger last revised February 21, 2012.

Frank Notaro on behalf of ROBERT SWING requests an Amendment to Wetland Permit #6978 to
include the existing on grade patio and to remove the portion within the 5' wide non-disturbance buffer.

The proposed action has been revieWed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
INCONSISTENT with the denoted following Policy Standards and therefore is INCONSISTENT with the
LWRP:
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other /ands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in
Trustee permit conditions
The structures were constructed without a permit pursuant to Chapter 275 Wetlands and Shorelines of
the Southold Town Code.
It is recommended that the structures be removed.
Additionally, if the action is approved and to further Policy 4.2 Protect and restore natural protective
features and Policy 6; it is recommended that non-disturbance buffer is increased from 5' to 10' in
width as a landscaped buffer.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

To Whom It May Concern:
After your inspection of the premises above, it was brought to my attention that your
office had a number of concerns. I would like to address each one:
The paver patio on grade that my Client's landscaper installed on the waterside of his
house intruded into the non-disturbance buffer by approx. 2'. This area will be removed
and the client is requesting a variance for the rest of the patio. The stone are typical
pavers and do not have a non-porous base.
The 6" pipe noted in you inspection is not a drainage pipe. It is a flood vent required by
FEMA and the Building Department. The only water flowing through it will be if the tide
rises to a condition where it floods the crawl space. All other site drainage is contained on
the site. The rain gutter leaders run into 2 catch basins that were inspected by the
Building Department prior to covering up. The French drain is not necessary since any
remaining rain water is minimal and will be absorbed by the grass. Also the French drain
would be placed lower than potential spring tides. We have witnessed this when
excavation tbr the water line was done on the road side of the house.

proposed actions that are subject to the Town of Southold Waterfxont Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in

IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee, Robert Swin~. residinu at 96 Gun Club Road, Northport, NY, as part of the
consideration for the issuance of the Permit does understand and prescribe to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own'
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 mouths, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Pennittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization waS. originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
ageuts, and non,compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the w~rk
herein authorized.
That there shall be no interference with the fight of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trnstees,
the work s.h~all cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon dueinotiee, to remove or alter this work project herein stated without
expenses to the Town of Southold.
The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

The Board of Town Trustees took the following action during its regular meeting held on
Wed., February 24, 2010 regarding the above matter:
WHEREAS, Frank Notaro, Architect on behalf of ROBERT SWING applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated January 26, 2010, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, in accordance with Chapter 268, said application was found to be Exempt
from the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Headng was held by the Town Trustees with respect to said
application on February 24, 2010, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees APPROVES the application of ROBERT
SWING to demolish the existing one-story (966 sq.ft.) with the existing foundation to
remain; add three (3) courses of concrete block to the existing foundation to comply to
FEMA flood regulations; construct a new 1% story dwelling on the existing
foundation/footprint including a second story loft/storage containing 580 sq.ft.+/-;
construct an addition to the landward side of the existing foundation/footprint containing
627 sq.ft.+/-; remove the existing sanitary system and replace with an updated sanitary
system within the front yard, install a retaining wall surrounding the sanitary system
measuring 118'+/-X1.3'+/- high, install a French drain along the southem side yard
property boundary and establish a 5' wide non-turf buffer along the landward side of the
bulkhead, with the condition of a pervious driveway, which is not to encroach into the
Town Right-of-Way, and a line of staked hay bales and silt fencing is installed prior to
construction activities and maintained throughout construction, and as depicted on the
survey prepared by John T. Metzger received on January 26, 2010 and stamped
approved on February 24, 2010, and plans prepared by Frank Notaro, Architect
received on January 26, 2010 and stamped approved on February 24, 2010.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is EXEMPT from LWRP review pursuant to:
§ 268-3. Definitions. MINOR ACTIONS item "B" which states:
B. Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same
site, including upgrading buildings to meet building or fire codes, except for structures in areas
designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be
replaced, rehabilitated or reconstructed without a permit;
The proposed action is not located within the CEHA.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
