Such a containment system must be approved by NYSDEC staff prior to placement of equipment,machinery or tank storage within 100 feet of the regulated wetland or waterbody. 7.All areas of soil disturbance resulting from this project shall be seeded with an appropriate perennial grass and mulched with straw immediately upon completion of the project, within two (2)days of final grading, or by the expiration date of this permit,whichever is first. Mulch shall be maintained until a suitable vegetative cover is established. In response, this letter serves to address certain issues raised in your letter and to clarify the steps necessary to move the site plan forward in the review process. An incomplete site plan application for this project was initially submitted to the Board on March 16, 2006. On January 24, 2007, the applicant submitted a revised site plan application and a more complete application package which was accepted by the Board at the January 26, 2007 work session with a request for minor revisions sent in a letter dated February 6, 2007. The application was then referred to Town Departments and involved/interested agencies. It should be noted that this version of the application proposed two buildings. Prior to making a determination on this application, the Board required your client to obtain wetlands permits from the Southold Board of Trustees("Trustees") and NYS DEC. A permit was issued by the Trustees on September 19, 2007 with the condition that the parking area be no closer than 60' to the wetlands. The plan,however, had changed significantly from what was originally submitted to the Board (it now showed one building instead of two), and thus required j a revised site plan application be submitted. i Mr. Bruce Anderson December 16, 2009 Page Two A revised application was submitted on March 6, 2008 and discussed at the March 17, 2008 work session. According to our records, various site plan application and planning issues were addressed at this work session. It was also noted that the Board agreed to a coordinated SEQRA review, as is their practice for all site plans involving new construction. Additionally, the new proposal required a variance for having a building 80 linear feet in length where the Code limits the width to 60 linear feet (this relief was granted by the ZBA on May 8, 2008). On April 3, 2008, you submitted revised plans in accordance with the March 17 work session, and suggestions made by Planning staff after an informal meeting. Upon reviewing the submitted plans, staff noted a discrepancy in the wetland boundary delineation between the existing conditions plan and the site plan. The allegation in your November 19 letter that staff purposely "derailed"this application is unfounded and unsupported in the record. Planning staff are required to review submitted plans to assist applicants through the process so that site plan applications are approved within the bounds of the law as dictated by the Town and State. In this instance, your submittal included two separate plans: one a survey showing existing conditions and the other a site plan showing the proposed construction. The wetland boundary delineations differed significantly on the two plans. The site plan's wetland delineation line was done on January 31, 2006 by Robert H. Fox. The line on the survey done May 22, 2006 by Suffolk Environmental showed wetlands much closer to the proposed building than the Trustee's permit would allow. This discrepancy between the two plans made it impossible for the Board to proceed with review of this site plan until it was resolved. Accordingly, the Board referred this discrepancy to the Trustees to resolve, as they have Town jurisdiction over wetlands issues (Chapter 275 of the Town Code), and did so on April 7, 2008. Concurrently, the DEC became involved as a result of your office contacting them for the required permit(the DEC permit requirement was acknowledged by your office in the Environmental Assessment Form you submitted to Planning on March 6, 2008). The DEC, also having jurisdiction over wetlands,made a site visit around this time, independent of the discrepancy identified by the Board, and found that some of the wetlands on and near the site had not been properly identified. The question of the actual location of the wetlands had to be answered prior to the Board processing the application further. The Board received the NYS DEC permit from your office on October 5, 2009. On October 23, 2009, staff informed you that the application was on the agenda for the November 11, 2009 work session. As a result of that work session, it was noted that additional information and map changes were necessary to complete the application. After a careful review of the records in the file, including your April 3, 2008 submittal, the Board has requested the following information be submitted: 1. Provide a description of what the proposed uses will be on site (requested in Nov.16 2009 letter). 2 Mr. Bruce Anderson December 16, 2009 Page Three 2. Clarify the Gross Floor Area (GFA) breakdown for each use including the apartment area and total GFA for the building (requested in Nov.16 letter). 3. Landscape Requirements. a. Provide a plan that demonstrates 35%landscaping coverage of the subject property as per Town Code Section 280-Bulk Schedule(requested in Nov.16 letter). b. Provide a 25' front landscaped area as per Town Code Section 280-93 (requested in Nov.16 letter). c. For vacant sites such as this one, the Planning Board has consistently required that site plans meet these code requirements. Any reduction in these requirements would need to have the agreement of the Planning Board, and a variance from the Zoning Board of Appeals. 4. Parking. Revise parking calculations to match town code requirements based on the proposed uses. Absent a definite proposed use for all the space, apply the most intense parking requirement, 1 parking space per 100 s.f. of gross floor area, for that part of the building that does not have a defined use. Also, show parking space locations that are proposed inside the building, including overhead door locations that match the construction plan. Last, include a loading berth for the proposed on site as per Town Code section 280-79 (requested in Nov.16 letter). Provide dimensions for parking stalls. 5. Cross-access location. Show the location of a cross-access to the parcel to the west (requested in Nov.16 letter). 6. Lighting plan. Although lighting fixture details have been submitted, a separate lighting plan has not. The site plan only shows the location of proposed lighting locations but does not demonstrate how lighting will be maintained on site. Provide a photometric plan having the isometric footcandle distribution diagram plotting the light levels for the fixtures at the designated mounting heights. It should be noted that the maximum height allowed for light poles is 14 feet. The photometric grid should include all proposed outdoor lights, and extend to just outside the property boundary except where it reaches zero within the site(requested in Nov.16 letter). 7. Dumpster Location. Show the location of any proposed dumpster and enclosure on the plan. 3 i Mr. Bruce Anderson December 16, 2009 Page Four 8. The rear yard setback should be noted on the plan from the building to the rear property line (requested in Nov.16 letter). 9. Trustee Permit. a. Your Trustees permit for the development has since expired(2 years from the date of approval 9/19/07). You will need to reapply to the Trustees office for approval (requested in Nov.16 letter). b. The plan shows a distance of 40 feet from the wetlands to the parking area. The plan must be in conformance with the Trustees permit condition that the parking area be no closer than 60' from wetlands (requested in Nov.16 letter). 10. Permit conditions (DEC, SC DOH, NYSDOT,Trustees).Any conditions placed in connection to an approval from other agencies are to be drawn/noted on the site plan (requested in Nov.16 letter). 11. It should be noted that approvals will be required by the NYS DOT and SC Health Department and Trustees prior to the Board approving this site plan (requested in Nov.16 letter). Upon receipt of the information requested above, the Board will review and process the application further. Some referrals would need to be re-sent as follows: Town Engineer,Town Building Inspector,NYS DOT, SC Health Department and Greenport Fire Department. Although referrals were done once before in early 2007, it is common practice to re-refer plans that have been significantly revised (e.g. changing from two buildings to one). This assures that agencies with jurisdiction are all reviewing the same plans. Some referrals will not be re-sent, including the Architectural Review Committee which has already reviewed and commented on the most recent plans, and Suffolk County Planning Commission, which has already made a determination of local significance. The review required under the State Environmental Quality Review Act(SEQRA)will be conducted as an Unlisted Action with a coordinated review. This is the policy of the Board for all new construction. The Board has increased the efficiency of coordinated review by combining the coordination letter with the referral letter. The Raritan Clay is relatively impermeable, and therefore, forms an aquitard between the Lloyd Sand Member and the overlying Magothy Formation. The Magothy Formation is the youngest of the Upper Cretaceous sediments and overlies the Raritan Clay. It consists mainly of lenticular and discontinuous beds of very fine to medium sand, commonly containing thin clay lenses. The Upper Pleistocene Formation lies unconformably above the Magothy Formation and composes the surficial deposits in the site area. The Upper Pleistocene Glacial Formation consists of fine to coarse stratified sand and gravel and/or till composed of unstratified mixtures of clay and boulders. Groundwater in the site area is derived from infiltration of precipitation through the surficial deposits to the water table. The water table is the upper limit of the groundwater reservoir and the impervious bedrock is the lower limit. According to the USGS, Southold, N.Y. topographic quadrangle, the elevation of the property is approximately 16 feet above mean sea level (AMSL). Based on the Suffolk County Department of Health Services, Water Table Map,the depth to groundwater is approximately 10-15 feet below grade and the regional groundwater flow direction is generally south toward Pipes Cove. 5 SECTION 3.0 RECORDS REVIEW 3.1 Historical Information The objective of reviewing historical records is to develop a history of the previous uses of the property and surrounding area, in order to help determine the likelihood of past uses having led to recognized environmental conditions in connection with the property. The historical sources searched during the preparation of this assessment were Sanborn Fire Insurance Maps, aerial photos, the Town of Southold Building Department files, and an interview with an adjoining property owner (the client). Sanborn Fire Insurance Maps were researched for the property and vicinity by Toxics Targeting, Inc.,of Ithaca,New York. The results of the search indicated that no coverage is available for the property vicinity. Historic aerial photographs were reviewed at the Suffolk County Planning Department for the years 1930's, 1966, 1970, 1980, and 1988. The conditions that could be identified for the subject property and adjoining properties are discussed below. • 1930's — The subject and adjoining properties to the north, east, and west are cleared land. The adjoining property to the south consists of Main Road,beyond which are two small structures. • 1966— The subject property is occupied by what appears to be a small shed associated with the development of the adjoining property to the west. The adjoining property to the north is vacant woodland. The adjoining property to the east is occupied by three small structures and vehicles. The adjoining property to the south is occupied by Main 6 IRoad, beyond which is a commercial building and vehicles. The adjoining property to the Iwest is occupied by what appears to be a residential structure and associated garages/sheds. • 1970—The subject property is cleared land with vehicles parked along Main Road on the south side of the property. The adjoining property to the north is vacant woodland. The adjoining property to the east is occupied by three small structures. The adjoining property to the south (across Main Road) is occupied by commercial structures and automobiles and/or boats. The adjoining property to the west is occupied by a residence. • 1980—The only significant change from the 1970 photo is the adjoining property to the east has been predominantly cleared. Only one small structure is visible on this property. • 1988 —Current conditions were observed on the subject and adjoining properties. The Town of Southold Building Department records for the subject property were reviewed. The Property Record Card revealed the property was once part of a larger parcel that included the current adjoining properties to the west. The current owner, Philee Realty Corp. purchased the property in 1970 from Josephine Benjamin. No buildings were recorded on the subject property. However, the property was approved for a new and used car lot in 1970. Building Department records indicated the adjoining property to the east was previously occupied by a gas station, residence, and cottage in 1961. The buildings were damaged in an explosion/fire in 1979. Based on the historical sources accessed,the subject property was once part of a larger parcel that included the adjoining lots to the west. The subject Property was developed with a small structure between the 1930's and 1966. This structure was subsequently removed between 1966 and 1970. The subject property was used as a used car lot in the 1970's and 1980's. The adjoining property to the east was developed as a gas station, residence, and cottage in 1961. An explosion 7 storage tanks, and auto parts were identified within the scrap metal accumulated near the northern property boundary. No other dumping, disturbed soil, mounding, or excavations were observed on the property. Pits. Ponds. or Lagoons IThe central portion of the property is inundated with surface water. There were no pits, ponds, or lagoons observed on the property. Stained Soil/Stressed Vegetation No stained soil or stressed vegetation was observed on the property. Solid Waste No solid waste is currently generated at the subject property. The scrap metal accumulated on the northern portion of the property should be considered solid waste. Radon According to the USEPA map of radon zones, the average radon concentrations in the property area are below the EPA's Action Level of four picocuries per liter of air. Therefore, radon does not appear to pose a concern in the property area. Asbestos and Lead-Based Paint Based on the absence of building materials on the property, asbestos and lead-based paint does not appear to pose concerns. Wetlands Based on the vegetation and surface water observed on the subject property,NYSDEC Tidal and Freshwater Wetlands maps were reviewed at the Southold Town Trustees office. The subject property does not appear to be located within a freshwater or tidal wetland.
