WILLIAM J. BOYLHART and RUTH H. BOYLHART, both residing at 2461 Bayshore
Drive,Newport Beach, California 92663, individually and as Trustees under Deed of Trust dated
1/1/1975;
party of the first part, and
ANDREW R MARTIN and LISA MARIE CASEY, both residi g at 450 North End Avenue,

WITNESSETH, that the party of the first part, duly nominated and appointed Trustee under
Deed of Trust dated 1/1/75, by virtue of the title and authority in me vested by the terms of said
Trust, and in consideration of SIX HUNDRED EIGHTY-FIVE THOUSAND ($685,000.00)
DOLLARS paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second'part forever,
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings'and improvements
thereon erected, situate, lying and being in the Town of Southold, County of Suffolk and State of
New York, known and designated as Lot No. 4 on a certain map entitled, "Map of Land's End at
Orient Point," prepared by Van Tuyl & Son, Surveyor, and filed in the Office of the Clerk of the
County of Suffolk on May 3, 1973, as Map No. 5909, Abstract No. 7286, being bounded and
described as follows:-
BEGINNING at a monument on the northerly side of Latham Lane which marks the division line
between Lots 3 and 4 on said map; and
RUNNING THENCE North 16 degrees 45 minutes 30 seconds East, along said division line,
378.70 feet to the apparent high water mark 8/99;
THENCE South 47 degrees 33 minutes 09 seconds East, along said apparent high water mark,
185.43 feet to the division line between Lots 4 and 5 on said map;
THENCE South 23 degrees 53 minutes 30 seconds East, along said division line, 280.99 feet to
the northerly side of Latham Lane;
THENCE northwesterly along said northerly side of Latham Lane, the following two (2) courses
and distances: (1) AlQng an arc of curve which bears to the left, having a radius of 220.00 feet
and a distance of 85.00 feet; (2)North 88 degrees 57 minutes 40 seconds West, 50.00 feet to the
monument at the point or place of BEGINNING.

' BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
dieed from William Vogel, dated 4/4/81 and recorded in the Suffolk County Clerk's Office on
5/22/81 in Liber 9006 cp 577.
TOGETHER WITH all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above-described premises to the center lines thereof;
TOGETHER WITH the appurtenances and all the estate and rights of the party of the first part
in and to the said premises which the party of the second part has the power to convey or dispose
of; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,
and/or assigns forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been incumbered in any way whatever, except as
aforesaid.
AND the party of the fust part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture
so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and
