The Chairman opened the hearing at 7:40 o'clock p.m. and read the notice of hearing and application for the ~ecord. CHAIRMAN GOEHRINGER: I have a copy of a survey. The most recent date is amended November 18, 1986 and then amended again April 14, 1987 indicating lot number one at 53,000 square feet which includes a two-story framed home and garage. Lot number two at 40,000 square feet which includes a one-story framed house. And lot number three at 40,000 square feet which also includes a one-story framed house. And that is produced by Roderick VanTuyl, P.e., that survey. And I have~a.'.copy of the Suffolk County Tax Map indicating this and sur- rounding properties in the area. ts there someone who would like to be heard concerning the Olmsted hearing? Is there anybody here representing the Olmsted hearing? Yes sir. Could I ask a couple questions maybe? Maybe you could use the mike and state your name for us. MR. OLMSTED: I'm Sidney Olmsted2 CHAIRMAN GOEHRINGER: Two of these houses have been there for a long period of time. Have they not? MR. OLMSTED: They have. CHAIRMAN GOEHRINGER: The house on~ lot number three which is the.one closest~ to the main chanel of Mattituck Inlet, Mattituck Creek so to speak, was built when? MR. OLMSTED: 1972 I think. CHAIRMAN GOEHRINGER: Are they all utilized as year around dwellings? MR. OLMSTED: One/in lots one and two and three is mo.re less a sum~mer house. I come weekends from April to November. CHAIRMAN GOEHRINGER: You~do have heat in it. And the other houses, on a guestimate, how'old would you say they were? MR. OLMSTED: The lot two, I would say around the turn of the century. Lot one, the two-story house, 1949. CHAIRMAN GOEHRINGER: Is there anything you would like to state for the record concerning this? MR. OLMSTED: No. Other than we are here in~.good faith and we would like to do this for the reasons we stated on the application. Probate reasons for the reason'that other tots in this same map have been sub- divided in the same way ~in the same area. CHAIRMAN GOEHRINGER: Thank you Mr. Olmsted. I just want to mention that we will not make an immediate decision tonight, we have other decisions from the last meeting that we have to make first. I thank you. MR. OLMSTED: Thank you. Goehringer, Members: Douglass, Sawicki and Grigonis and Doyen. Also Present: Victor Lessard, Building Dept. Linda Kowalski, Z.BoA. Secretary and approximately persons in the audience. Resolution adopted to eliminate reading of the application for the record. The Chairman opened the hearing at 7:45 o'clock p.m. and read the notice of hearing for the record. CHAIRMAN GOEHRINGER: I have a copy of a survey produced from Young and Young dated January 4, 1980 indicating a two-story framed build- ing, house, dwelling I should~say, and two floor plans in the file. The first floor plan indicating; 1,22t square feet and plus or minus. And a second floor plan indicating; 884 square feet. And'I have a copy of the~SUffotk County Tax Map indicating this and surrounding properties in the area. Is there somebody who would like to be heard on behalf of this application? Anybody here from ..... ? Could I ask you to use the mike sir. We'll ask a couple questions anyway. Could you just state your name for the record. MR. STURCKEN: Tony Sturcken. CHAI~q~N GOEHRINGER: In the utilization o~ the second floor area, when you calculated the 884 square feet; did that include the hallway and everything else, the entire upstairs? MR. STURCKEN: It included the entire area. CHAIRMAN GOEHRiNGER: And you intend to enter that through the front door or where is that going to be entered? MR. STURCKEN: A front entrance. CHAIRMAN GOEHRINGER:: where it is? Ahd you'll go up the front stairway i.f that is MR. STURCKEN: Correct. But there may be other requirements of you concerning this particular appeal assuming that we grant it from the Building Department. You may be required to put in another stairwell or whatever. And that's something that's beyond our control. I just wanted to point that out. Is there anything you would like to state for the record? MR. STURCKEN: No. Other than this space is available. And if we ever did rent it upon approval, that a member of'-.~he Cutchogue Fire Depart- ment would probably be Only rented to a fellow member of the Fire De- partment. Some of these young guys are moving out of town. They don't have a place to stay. We're fortunate that we just have the room and this is what we're trying~to d~. We're not contemplating a business. JOHN WHITTIER Locati©n of PropertY: N/s North View Drive, Orient County Tax Map ID NO: 1000-13-1-7. Board Members present: Chairman Gerard P. CHAIRMAN GOEHRINGER: I have a copy of a survey ~mended February 29, 1988 indicating a partial demolition of the.existing onevstory struc- ture and an addition making it approximately twiCe the size and in- creasing the size of the deck on the rear of the building. And Z[ have a copy of the Suffolk County Tax Map indicating this and surrounding properties in the area. And I have a copy of the plans produced by Elizabeth Thompson, Architect indicating the work that is proposed in this particular application. And I'll ask who ever would like to speak. We usually have 15 or 20 hearings on one night. We're just so relaxed tonight. It's really enjoyable to be honest With you.~ Do you want to state something for the record? MS. THOMPSON: Sure. I can address the three points that we're seek- ing a variance on. In the rear on the bluff side, we're merely staying in line with the_existing building. WE're n0t~extending any closer to the bluff in any building design. So we're not extending any closer to.the bluff. We've gotten a consulting engineer to advise on a special footing that will respect the .integrity of the bluff. I believe there is a detailed footing in the drawings therelif_~you have it. It cuts straight down and kicks back in under the building. It does not kick out toward the bluff. All the framing necessary for the pour~remains in.~ptace. So we're not disturbing the bluff at all. On the front, where the Whittier's want to pUt a garage in ~%here, the survey shows 13 feet from the face of the addition to the street. I~actuality, it's about 30 feet. The road is just in a different location than the survey shows. Thirty feet would allow a car to back ~ut of the garage and then drive forward around the driveway and enter the street facing ~age 2 - Thursday, June 9, 1988 -21- ~ Public Hearing - Dr. & Mrs. John Whittier Southold Zoning Board of Appeals MS. THOMPSON (continued): front. So it would not be hazardous if there's any hazard entering the street. In addition, increasing the size of the buiIding, we're renovating the existing building and upgrading it. The".W~ittier"s are retiring out here and they've been coming summers to this house for 30 years. And we'need to upgrade it for Winter, full time Winter use. Part of that is upgrading aesthetically as well so it fits into the neighborhood. CHAIRMAN GOEHRINGER: i understand your feelings toward the situation of the~-f~ct~that the road is not as wide as it appears to be regard- less of where it is in position. But we still have to address the is- sue of 13 feet to the property line. And my question is; with the available property on the east side, why can't you put a side entrance garage in rather than a front entrance garage? MS. THOMPSON: The Whittiers will have a problem getting it plowed in the Winter time. When we did address it, we talked to the man who plows up through Brown's Hills and they f~el they ne~d~to get out im- mediately in a snow storm. They have to get out in a snow storm. If it's a doctor or something like. that, they waht to make sure that they get plowed out quickly. CHAIRMAN GOEHRINGER: Well, that's the only question that I haven We will see what other Board members have. Is there anybody else who would like to address this issue? Or any' issue simiiiar consequence? No. Ok. I guess there's no further questions. I thank you. You don't have to get up. Will there be a full basement in this or a partial basement? MS. THOMPSON: It's adding a crawl space. There is a basement. CHAIRMAN GOEHRINGER: Ok. I' remember seeing that in the'plan, ~ just don't recollect it in front of me. Y~u're not extending the basement. MS. THOMPSON: We're ~realiy just accommodating the special permit. CHAIRMAN GOEHRINGER: Ok. I thank you. Is there anybody else who would like to speak in favor of this application? Yes ma~am. MS. ROBINSON: President of the Brown's Hills Estates. we feel this would be an asset to the nei~hborhood to have them go ahead and do this improvement.
