WITNESSETH, that the party of the first part, in consideration of
Ten Dollars and other valuable consideration paid by the party of
the second part , does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party
of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings
and improvements thereon erected, situate, lying and being at East
Marion, Town of Southold, County of Suffolk, and State of New York,
bounded and described as follows :
BEGINNING at a point on the Southerly side of Rabbit Lane (Private
Road) distant the following two courses and distances as measured
along the Southerly side of Rabbit Lane from its intersection with
the Easterly side of Bay Avenue;
1) North 690 17' 10" East 125 . 50 feet ;
2) North 56o 57' 50" East 162 . 10 feet to the point of
beginning;
running thence from said point along the said Southerly side of
Rabbit Lane the following courses and distances :
1) North 56o 57' 50" East 3 . 81 feet ;
2) North 460 59' 50" East 59 . 09 feet to land now or formerly
of Oak Grove Beach Association;
running thence along said land South 34o 12 ' 40" East 87 feet to
the ordinary high water mark of Gardiner' s Bay;
running thence Westerly along the ordinary high water mark of
Gardiner' s Bay on the tie line having a bearing of South 42o 15'
50" West for a distance of 63 . 97 feet to land now or formerly of
Oak Grove Beach Association.
Running thence along said land North 34o 12 ' 40" West 93 feet to
the Southerly side of Rabbit Lane and the point or place of
beginning.
TOGETHER with all interest of the party of the first part in and to
the land under the waters of Gardiner' s Bay (Peconic Bay) adjacent

BEING the same premises cony yed by the party of the second part to
the party of the first part recorded in Liber 8487, Page 569, in
the Office of the Clerk of Suffolk County on August 29, 1978 .
TOGETHER with all right, title and interest, if any, of the party
of the first part in and to any streets and roads abutting the
above described premises to the center lines thereof; TOGETHER with
the appurtenances and all the estate and rights of the party of the
first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the second part
forever.
AND the party of the first part, in compliance with Section 13 of
the Lien Law, covenants that the party of the first part will
receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied
first for the purpose of paying the cost of the improvements and
will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any
other purpose .
