DECLARATION OF
PROTECTIVE COVENANTS AND RESTRICTIONS

DECLARATION made this dB day of f'f'~L ,2002, by RAYMOND JAY
AKSCIN and STELLA M. AKSCIN, both residing at 1800 Cedar Beach Road, Southold,
New York 11971, hereinafter called the Declarants.
WHEREAS, the Declarants have title to certain land, situate, lying and being at
Southold, Town of Southold, County of Suffolk and State of New York, which is more
particularly described in Schedule A which is attached hereto; and
WHEREAS, the Declarants have applied to the Town of South old Planning Board
for a minor subdivision of the property described in Schedule A, a copy of which map is
attached hereto as Schedule B; and
WHEREAS, the Declarants desire to make this Declaration setting forth
reservations, restrictions, covenants, conditions and agreements, subject to which the
property on said map is now held and shall be sold and conveyed.
NOW, THEREFORE, the aforedescribed premises shall be subject to the
following covenants and restrictions, which shall run with the land:
1. Each lot is a parcel which is separately numbered as a lot on the subdivision
map.
2. No lot shall be further subdivided or its lot lines changed in any manner at any
future date unless authorized by the Town of Southold Planning Board.
3. Lots #2, #3 and #4 will have a permanent deeded access over the right-of-way
shown on Lot # I on the Minor Subdivision Map for the purpose of ingress and egress,
and for the installation and maintenance of utilities such as electric, telephone, cable TV
and water lines. The cost of the maintenance of the private road and any catch basins
provided for herein shall be shared equally by the owners of the four lots of this minor
subdivision and any decisions regarding the maintenance of said private road shall be
decided by a majority vote of the owners of the four lots of this minor subdivision; each
lot having one such vote.
4. Domestic water to any dwelling on any of the lots shall be furnished by the
Suffolk County Water Authority.
5. No electric or telephone poles shall be allowed on the premises as all utility
services for electric, telephone and cable TV will be installed by a residential
underground system.

6. No building activity shall take place within one hundred (100) feet of the
wetland area All runoff from buildings, pavement, fertilizer and vegetation shall be kept
out of the wetlands by dry wells or other preventive methods.
7. The Declarants grant the Town of Southold or its designated agents the right
in perpetuity to inspect the property to comply with these Covenants and Restrictions and
the right to take any enforcement actions as deemed necessary.
8. The foregoing Covenants and Restrictions shall bind the Declarants, their
heirs, successors and assigns of any and all persons who shall succeed to ownership of
said premises or any part thereof by transfer or otherwise.
THESE Covenants and Restrictions can be modified only at the request of the
then owner of the premises with the approval of a majority plus one of the Planning
Board of the Town of South old after a public hearing. Adjoining property owners shall be
entitled to notice of such public hearing, but their consent to such modification shall not
be required.
IN WITNESS WHEREOF, the Declarants have duly executed this Declaration
