WITNESSETH, that the party of the first part, by virtue of the power and authority given in and by said last
will and testament, and in consideration of

BLOCK: Beginning at a point on the westerly line of a strip of land 25 feet or more in width known as Truman's Path,
12 where the same is intersected by the northerly line of land now or formerly of Foster; running thence
northerly, along the westerly line of Truman's Path, 50 feet to land of Kniep; thence south 64 degrees 5
LOT: minutes 40 seconds west, 100 feet; thence continuing the same course, a distance of 170 feet to the easterly
14 line of Marion Lake; thence in a general southerly direction, along the easterly line of Marion Lake to the
northerly line of land now or formerly of Foster; thence along land last mentioned, north 64 degrees 5
minutes 40 seconds east, 275 feet, more or less, to the point or place of beginning.
Together with a right of way running 25 feet in width known as Truman's Path from the Main Road to a
point marking lands now or formerly of Vail;thence southwesterly about 335 feet and thence southeasterly
about 200 feet to the bay, said right of way being but 16 feet in width at the northerly end and the most
southerly courses thereof being in varying widths.
Subject to any state of facts an accurate survey might show, and to covenants, restrictions, easements,
agreements, reservations, and zoning regulations of record, if any.
BEING AND INTENDED TO BE the same premises conveyed to Elsie A. Schmitt, deceased,by dbed
dated February 1, 1967, and recorded in the Office of the Suffolk County Clerk on March 10, 1967 in Liber
6124 Page-484.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances,
and also all the estate which the said decedent had at the time of decedent's death in said Premises, and also
the estate therein, which the party of the first part has or has power to convey or dispose of, whether individ-
ually, or by virtue of said will or otherwise; TO HAVE ARID TO HOLD the premises herein granted unto
the party of the second part, the heirs or successors and assigns of the party of,the second part forever.
AND the arty of the first part covenants that the party of the first part has not done or suffered anything
whereby thersaid premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this convecance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word party' shall be construed as if it read "Parties"' whenever the sense of this indenture so requires.
