Philip J. Ofrias, Jr. aril Sharyn Ofrias, his wife, both residing at
Bayview Road, Southald, New York, having applied to the Planning Board of
the Town of Southold for permission to divide the prEmises described below
in Schedule A into two separate parcels, am said application having been
treated as a minor sub-division by the Planning Board, arrl the Planning
Board having granted approval to the minor sub-division uJXln the giving of
the covenant by philip J. Ofrias, Jr. arrl Sharyn Ofrias, his wife, that
no future application will be made for further sub-division, Philip J. Ofrias
Jr. arrl Sharyn Ofrias, his wife hereby covenant arrl agree as follows:
1. 'lhat this covenant shall not becane effective unless ariluntil
there is a conveyan::::e out of less than the entire prEmises described in
Schedule A, or by a conveyance cut of the entire prEmises described in
Schedule A in more than one parcel.
2. 'lhat subsequent to this covenant becaning effective Philip J.
Ofrias, Jr. arrl Sharyn Ofrias, his wife, their heirs or assigns shall not
further sub-divide nor: make future application to further sub-divide the
prEmises described in Schedule A nor any part thereof.
3. 'lhat the Planning Board of the Town of Southald or any other
board or agency of the Town of Southold then having jurisdiction of the
matter shall have the power to terminate this cov at anytime.
