THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION NO. 2010-93 WAS
ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON
JANUARY 19, 2010:
WHERAS, the road improvements to the southerly portion of Ryder Farm Lane
and all of Park View Lane shown and designated on a certain map entitled "Map
of Orient by the Sea", Section 2, from the County of Suffolk to the Town of
Southold (Suffolk County Tax Map No. District 1000, Section 015.00, Block
05.00, Lot 025.003), have been completed by the Town; now therefore be it
RESOLVED that the Town Board of the Town of Southold hereby authorizes
and directs Supervisor Scott A. Russell to execute ali necessary documents in
connection with the ~)uitclalm Deed regarding the transfer of the southerly
portion of Ryder Farm Lane and all of Park View Lane~ as shown and
designated on a certain map entitled "Map of Orient by the Sea"~ Section 2~
from the County of Suffolk to the Town of Southoid (Suffolk County Tax
Map No. District 1000~ Section 015.00~ Block 05.00~ Lot 025.003), subject to
the approval of the Town Attorney; and be it further
RESOLVED that the Town Board of the Town of Southold hereby authorizes the
payment of second half real property taxes for the 2008-09 tax year in the sum of
$142.39, payable to the Suffolk County Treasurer, said payment shall be a legal
charge to the Orient by the Sea Road Improvement project within the Capital
Fund (H.5110.2.400.100); and be it further
RESOLVED that the recording fees, estimated to be $345.00, shall be a legal
charge to the Orient by the Sea Road Improvement project within the Capital
Fund (H.5110.2.400.100); and be it further
RESOLVED that once said payments are recorded in the financial records of the
Town of Southold, the Orient by the Sea Road Improvement project within the
Capital Fund (H.5110.2.400.100) is closed with any leftover appropriations to be
used strictly to retire the Town debt issued for this project in accordance with
New York State law.

QUITCLAIM DEED
THIS INDENTURE, made the h~- day of ~ , 2007
BETWEEN the COUNTY OF SUFFOLK, a municipal corporation of the
State of New York, having its principal office at the Suffolk
County Center, Center Drive, Riverhead, New York 11901, party of
the first part, and
Town of Southold, a municipal corporation of the State of New
York, having its principal offices at 53095 Main Road, P.O. Box
1179, Southold, New York 11971, party of the second part,
WITNESSETH, that the party of the first part, pursuant to
Resolution Number 576-2007 adopted by the Suffolk County
Legislature on June 12, 2007 and, thereafter, approved by the
County Executive on June 28, 2007, in consideration of Ten
dollars paid by the party of the second part, does hereby
remise, release, and quitclaim unto the party of the second
part, the heirs or successors and assigns of the party of the
second part forever,
ALL, that certain plot, piece or parcel of land with any
buildings and improvements thereon erected, situate, lying and
being in the Town of Southold, County of Suffolk and State of
New York, described on the Tax Map of the Suffolk County Real
Property Tax Service Agency as District 1000, Section 015.00,
Block 05.00, Lot 025.003, and acquired by Tax Deed on May 18,
1990, from General L. Rains, the Deputy County Treasurer of
Suffolk County, New York and recorded on May 25, 1990, in Liber
11074, CP 159,
FURTHER, notwithstanding the above description, it is the
intention of this conveyance to give title only to such property
as was acquired by the County of Suffolk by Tax Deed on certain
roadways. The Southerly portion of Ryder Farm Lane, said portion
being that part of the roadway between the Southerly line of
Plum Island Lane to its terminus on Main Road AKA S.R. 25 and
all of Park View Lane, as shown and designated on certain map
entitled ~Map of Orient By the Sea", Section 2, and filed in the
Suffolk County Clerk's office on October 16, 1974 as Map No.
3444.
PROVIDED, however, that the Totem of Southold will be
restricted in its use of the subject premises and will use said
premises solely and exclusively for roadway purposes; with all
right title and interest reverting to the party of the first
part in the event that the Town of Southold, at any time, uses
or attempts to use said subject premises for other than roadway
purposes or attempts to sell, transfer or otherwise dispose of
said subject premises without said premises being used
thereafter for roadway purposes. This covenant and restriction
will run with the land and shall bind the heirs or successors
and assigns of the party of the second part,
TOGETHER with all right, title and interest, if any, of the
party of the first part of, in and to any streets and roads
abutting the above-described premises to the center lines
thereof;
TOGETHER with the appurtenances and all the estate and rights
of the party of the first part in and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the
party of the second part, the heirs or successors and assigns of
the party of the second part forever.
SUBJECT to all covenants, restrictions and easements of
record, if any.
SUBJECT to the condition that neither Grantee nor any
Municipality shall bill or charge back to Grantor any cost
incurred or projected to be incurred for the cleaning up of any
debris on said property. In the event that such charge back or
bill is rendered to the Grantor this Deed shall be void ab
initio and the realty shall revert to the Grantor.
AND the party of the first part, in compliance with Section
13 of the'Lien Law, hereby covenants that the party of the first
part will receive the consideration for this conveyance and will
hold the right to receive such consideration as a trust fund to
be applied first for the purpose of paying the cost of the
improvement and will apply the same first to the payment of the
cost of the improvement before using any part of the total of
the same for any other purpose.
THE WORD "PARTY" shall be construed as if it read "parties"
whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly
executed this deed the day and year first above written.
