roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD
the premises herein granted unto the party of the second part,the heirs or successors and assigns of the party of
the second pa forever.
AND the party of the first pa covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first pa,in compliance with Section 13 of the Lien Law,covenants that the party of the
first pa will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fwd to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose.
The word"parry"shall be construed as if it read"parties"whenever the sense of this indenture so requires.

heirs and assigns forever,all that certain lot, plot or par-
cel of land, situate at East Marion, in the Town of Southold, County
of Suffolk and State of New York, described as lot number fifty-three
(53) and the southerly one-half of lot number fifty-four (54) as shown
on a map entitled "Map of Section Two Gardinerls Bay Estates, situate
at East Marlon, Long Island" which map was filed in Suffolk County
Clerk's office on September 23rd, 19272 under the number 275. The
premises are described according and with reference to said map as
being at the northwesterly corner of Locust Court and Sylvan Drive,
being rectangular in shape and 75 feet on Sylvan Drive and 100 feet
on Locust Court.
TOGETHER with a right of way to pass and repass for street pur-
poses over all streets on said map including "the paths" leading to
t1le beach.
TOGETHER, in common with others and subject to all restrictions,
reservations, covenants , agreements and payments to be made, as set
forth in prior deeds of record, with the right to use the beach lying
between Spring Fond and the bay and Old Orchard Lane and the Channel
marked upon the said map as "Beach for use of lot owners" for bathing
and similar purposes, and a right of way over Old Orchard Lane and
over the Beach to the adjacent waters.
