and CUTCHOGUE DEVELOPMENT LLC, a New York Domestic Limited Liability Company, having its
principal place of business at 2090 Sound Avenue, Baiting Hollow, New York 11933, Party of the Second Part,
WlTNESSETH, that the Party of the First Part, in consideration of TEN DOLLARS AND 001100 *****($10.00) .....
AND OTHER GOOD AND VALUABLE CONSIDERATION paid by the Party of the Second Part, does hereby
grant and release unto the Party of the Second Part, the heirs
or successors and assigns of the Party of the Second Part forever,
ALL that certain plot, piece or parcel of land, ~vith the buddings and ~mprovements thereon erected, s~tuate,
lying and being at Cutchogue, in the Town of Southold, County of Suffolk and State of New York, being more
~articularly bounded and described as follows:
BEGINNING at the corner formed by the intersection of the Northwesterly side of Main Road (NYS Route
.~5) with the Northeasterly side of Depot Lane;
RUNNING THENCE North 41 degrees 33 minutes West, along the Northeasterly side of Depot Lane,
233.70 feet to land now or formerly of Bialecki;
THENCE along last mentioned land, the following two courses and distances:
1. North 50 degrees 20 minutes 10 seconds East, 66.70 feet;
2. South 54 degrees 31 minutes 40 seconds East, 199.77 feet to the Northwesterly side of Main Road;
THENCE along the Northwesterly side of Main Road, 124.73 feet to the point or place of BEGiNNiNG.
BEING AND INTENDED TO BE the same premises described in Deed to the Grantor herein dated May 9,
2008 recorded May 16, 2008 at Liber 12551 Page 345.
TOGETHER with all dght, title and interest of the Party of the First Part in and to any streets and roads abutting the
above described premises to the center lines thereof, TOGETHER with the appurtenances and all the estate and
dghts of the Party of the First Part in and to said premises. TO HAVE AND TO HOLD the premises herein granted
unto the Party of the Second Part, the heirs or successors and assigns of the Party of the Second Part forever.
AND the Party of the First Part convents that the Party of the First Part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the Party of the First Part, in compliance with Section 13 of the Lien Law, covenants that the Party of the First
Part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using nay part of the total of the same for any other purpose.
The word "Party" shall be construed as if it read "Parties" whenever the sense of this indenture so requires.
